RESOLUTION NO. 140770

 

Approving the Swope Area Plan as a guide for the future development and public investment within the area bounded generally by the Brush Creek Corridor on the north, the Blue River Corridor and Swope Park on the east, the Trolley Track Trail Corridor on the South, and Troost Avenue/The Paseo Blvd on the west; amending the South Development Area Plan, Oak Park South Area Plan, Brush Creek Corridor Land Use and Development Plan, South Central Area Plan, Eastgate Land Use and Development Plan, and the 63rd Street Corridor Plan by deleting the portion of those plans covered by the Swope Area Plan; and repealing and replacing the East Meyer Boulevard Area Plan, Town Fork Creek Area Plan, Town Fork Creek Neighborhood Plan, Mount Cleveland Neighborhood Plan, and the Blue Hills Neighborhood Plan. WHEREAS, on January 15, 1971, the City Council by Ordinance No. 38861 adopted the South Development Area Plan; and

WHEREAS, said Plan has been further amended by Resolution No. 62808, adopted September 8, 1988; by Resolution No. 62713, adopted February 2, 1989; by Resolution No. 900405, adopted October 25, 1990; by Resolution No. 930894, adopted September 30, 1993; by Resolution No. 940780, adopted July 14, 1994; by Resolution No. 941542, adopted December 7, 1994; by Resolution No. 970046, adopted February 13, 1997; by Resolution No. 990060, adopted February 22, 1999; by Second Committee Substitute for Resolution No. 001262, adopted November 30, 2000; by Resolution No. 010819, adopted June 14, 2001; by Resolution No. 070353, adopted April 12, 2007; and by Resolution Number 130311, adopted April 25, 2013; and

WHEREAS, on August 18, 1977, the City Council by Resolution No. 48098 adopted the Oak Park South Area Plan; and

 WHEREAS, the City Council amended said Oak Park South Area Plan on June 1, 1989, by Resolution No. 63217, and the City Council further amended said plan on March 26, 1992, by Resolution No. 920133, and the City Council further amended said plan on June 30, 1994, by Resolution No. 940643, and the City Council further amended said plan on June 5, 1997, by Resolution No. 970571, and the City Council further amended said plan on May 20, 1999, by Resolution No. 990583, and the City Council further amended said plan on September 27, 2001, by Resolution No. 011205, and the City Council further amended said plan on October 24, 2002, by Resolution No. 021198; and the City Council further amended said plan on January 4, 2004, by Resolution No. 031334; and the City Council further amended said plan on January 13, 2005, by Resolution No. 041369; and the City Council further amended said plan on April 21, 2011, by Resolution No. 110159; and

 

WHEREAS, on February 11, 1999 the City Council by Resolution No. 981497 adopted the Brush Creek Corridor Land Use and Development Plan; and

WHEREAS, on March 21, 1980, the City Council by adoption of Resolution No. 51319 adopted the South Central Area Plan being the plan for development and redevelopment of that area bounded by Volker/47th Street on the north, 63rd Street on the south, Prospect Avenue on the east and Oak Street on the west; and

 WHEREAS, said South Central Area Plan was amended on June 18, 1989, through the adoption of Committee Substitute for Resolution No. 63221; was again amended on November 30, 1989, through the adoption of Resolution No. 64742; was amended on November 6, 1997, through the adoption of Resolution No. 971077; was amended on February 11, 1998, through the adoption of Resolution No. 981498; was amended on March 18, 1999, through the adoption of Resolution No. 990137; was amended on July 12, 2001, through the adoption of Resolution No. 010947; was amended on November 7, 2002, through the adoption of Resolution No. 021247; and was further amended on January 8, 2004 through the adoption of Resolution No. 031325; and was further amended on December 6, 2007 through the adoption of Resolution No. 071219; and

WHEREAS, on October 20, 2001, the City Council by Resolution No. 011676 adopted the Eastgate Land Use and Development Plan as a guide for the future development and redevelopment for the area generally bounded by the Missouri Pacific Railroad line on the west, Interstate 435 on the east, Coal Mine Road on the north and 63rd Street Trafficway on the south; and

WHEREAS, the City Council amended said plan on April 8, 2010, by Resolution No. 091008; and the City Council further amended said plan on August 21, 2014, by Resolution No. 140661; and

WHEREAS, on November 7, 2002, the City Council by Resolution No. 021244 adopted the 63rd Street Corridor Land Use and Development Plan as a guide for the future development and redevelopment for the area generally bounded by Wornall Road on the west, Bruce R. Watkins Drive (U.S. Highway 71) on the east, 59th Street on the north and Meyer Boulevard on the south; and

WHEREAS, the City Council amended said plan on April 8, 2010, by Resolution No. 100211; and the City Council further amended said plan on September 25, 2008, by Resolution No. 080901; and

WHEREAS, by Resolution No. 48080 adopted August 11, 1977, the City Council adopted the East Meyer Boulevard Area Plan as a guide for development and redevelopment of that area generally bounded by 63rd Street on the north, the Blue River on the east, 79th Street on the south (except 75th Street on the south from Prospect Avenue to the Blue River) and Troost Avenue on the west; and

 WHEREAS, the East Meyer Boulevard Area Plan was amended on August 9, 2001, by Resolution No. 011049; and the City Council further amended said plan on November 7, 2002, by Resolution No. 021245; and

WHEREAS, the Town Fork Creek Area Plan was approved by Resolution No. 48787, adopted March 10, 1978, for that area generally located between Blue Parkway and 63rd Street, and between Prospect and the Big Blue River; and

WHEREAS, the Town Fork Creek Area Plan was amended on November 30, 1989, by Resolution No. 64741; was amended on March 26, 1992, through the adoption of Resolution No. 920131; and the City Council further amended said plan on June 30, 1994, by Resolution No. 940642; and the City Council further amended said plan on December 20, 2001, by Resolution No. 011677; and the City Council further amended said plan on November 7, 2002, by Resolution No. 021246; and the City Council further amended said plan on June 6, 2002, by Resolution No. 020585; and the City Council further amended said plan on January 8, 2004, by Resolution No. 031327; and the City Council further amended said plan on February 26, 2004, by Resolution No. 040141; and was further amended on November 17, 2005, through the adoption of Resolution No. 051301; and the City Council further amended said plan on December 11, 2008, by Resolution No. 081140; and

WHEREAS, on November 17, 2005 the City Council by Resolution No. 051300 adopted the Town Fork Creek Neighborhood Plan; and

WHEREAS, the City Council amended said plan on September 12, 2013, by Resolution No. 130647; and

WHEREAS, on May 30, 1996 the City Council by Resolution No. 960547 adopted the Mount Cleveland Neighborhood Plan; and

WHEREAS, on January 8, 2004 the City Council by Resolution No. 031326 adopted the Blue Hills Neighborhood Plan; and

WHEREAS, the stakeholders of the Swope Area in conjunction with the City Development Department have conducted a study delineating the characteristics of the Swope Area; and 

WHEREAS, the City Plan Commission considered such repeals and amendments of existing plans and approved the new plan on September 2, 2014; and

 WHEREAS, after all interested persons were given the opportunity to present testimony, the City Plan Commission did on September 2, 2014, recommend approval of the proposed repeals and amendments of existing plans and approval of the Swope Area Plan; and

  WHEREAS, the Swope Area Plan has incorporated the policies of the FOCUS Kansas City Plan and other appropriate planning documents; and  

WHEREAS, the policies within the Swope Area Plan, which will serve as the plan of record for this area, are consistent with the policies of the FOCUS Kansas City Plan, and any future amendments to the Swope Area Plan should be guided by and comply with the policy direction set forth in the FOCUS Plan; and 

WHEREAS, as a result of the study, the City Development Department has proposed a framework for the orderly development and redevelopment within the Swope Area Plan area; and

 WHEREAS, said framework provides a guide for future development and redevelopment of the area, for specific and general policies to guide future decisions, and for identification of public and private needs throughout the community and possible solutions to those needs; and

  WHEREAS, the City Development Department has incorporated its findings in the Swope Area Plan; NOW, THEREFORE,

 BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:

  Section A. That the Swope Area Plan is hereby adopted as a guide for the future development and public investments for that area generally bounded by Brush Creek Corridor on the north, the Blue River Corridor and Swope Park on the east, the Trolley Track Trail Corridor on the South, and Troost Avenue/The Paseo Blvd on the west. A copy of the Swope Area Plan is attached hereto, in substantial form, and is hereby approved.

Section B. That the South Development Area Plan, Oak Park South Area Plan, Brush Creek Corridor Land Use and Development Plan, South Central Area Plan, Eastgate Land Use and Development Plan, and the 63rd Street Corridor Land Use and Development Plan are hereby amended by deleting the portion of these plans that are covered by the Swope Area Plan.

Section C. That the East Meyer Boulevard Area Plan, Town Fork Creek Area Plan, Town Fork Creek Neighborhood Plan, Mount Cleveland Neighborhood Plan, and the Blue Hills Neighborhood Plan are hereby repealed and replaced by the Swope Area Plan.

  Section D. That the Swope Area Plan is consistent and complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by Committee Substitute for Resolution No. 971268, and is adopted as a supplement to the FOCUS Kansas City Plan.

  Section E. That the Council finds and declares that before taking any action on the proposed Swope Area Plan hereinabove, all public notices have been given and hearings have been had as required by law.
