Approving
an amendment to a previously approved development plan in District GP-2 (General
Transient Retail Business) on approximately a 20 acre tract of land generally
located at the northwest corner of N.W. 112th Street and N. Ambassador Drive.

BE
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section
A. That an amendment to a previously approved development plan in District
GP-2 (General Transient Retail Business) on approximately a 20 acre tract of
land generally located at the northwest corner of N.W. 112th Street and N.
Ambassador Drive, and more specifically described as follows:
A tract of land in the Southeast Quarter of
Section 23, Township 52, Range 34 Kansas City, Platte County, Missouri,
described as follows: Beginning at a point 1325.47 feet east of and 60 feet
north of the South Quarter Corner of Section 23, Township 52, Range 34; thence
North 0E04'00" East,
1021.24 feet; thence South 89E57'00"
West, 1021.24 to a point on the easterly right of way line of Interstate Route
29; thence South 7E25'55" East along
said right of way line, 283.67 feet; thence South 15E20'41" East along said right of way
line, 435.10 feet; thence South 56E12'46"
East along said right of way line, 530.26 feet; thence North 89E57'00" East along said right of way
line, 200.0 feet; thence South 0E03'00"
East, 20.0 feet; thence North 89E57'00"
East along the apparent northerly right of way line of a county road, 226.83
feet to the point of beginning. Containing 20.0 acres.
is
hereby approved, subject to the following conditions:
1. That
the developer submit a storm drainage study for the entire development to the
City Engineers Office for approval and that the developer make any
improvements as required by the City Engineers Office.
2. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
3. That
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
4. That
the developer dedicate an additional 9 1/2 feet of right of way for N.
Ambassador Drive as required by the Department of Public Works prior to the
issuance of a building permit.
5. That
the developer construct sidewalks along N.W. 112th Street and N. Ambassador
Drive as required by the Department of Public Works prior to the issuance of a
building permit.
6. That
the developer grant a Noise and Aviation Easement to the City as required by
the Aviation Department prior to the issuance of a building permit.
7. That
the developer secure the approval of the Missouri Department of Transportation
for any work within State right of way.
8. That
the developer secure the approval of the Board of Zoning Adjustment for a
variance to the required 50 foot setback from arterial streets as required by
Chapter 80, Appendix A, Section 4.1(B).
9. That
the developer submit a final plan to the City Plan Commission for approval,
including detailed information on landscaping (including canopy shade trees
along N.W. 112th Street and N. Ambassador Drive a maximum of 50 feet on center
and landscape screening of the trash enclosure on the convenience store phase),
signage (including elevations), lighting (including luminaire design and
photometric study), building elevations, and pedestrian connections (show
sidewalks to be constructed along the private drive).
A
copy of said amendment is on file in the office of the City Clerk under
Document No. 020278, which is attached hereto and made a part hereof.
Section
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
