ORDINANCE NO. 030304
an amendment to a previously approved development plan in District PD/C-2 (Planned
District/Neighborhood Retail Business) on approximately a 6.82 acre tract of
land generally located at the southeast corner of the intersection of N.W.
Barry Road and N. Congress. (12378-PD-9)
IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
A. That an amendment to a previously approved development plan in District
PD/C-2 (Planned District/Neighborhood Retail Business) on approximately a 6.82
acre tract of land generally located at the southeast corner of the
intersection of N.W. Barry Road and N. Congress, and more specifically
described as follows:
All of Barry Plaza First Plat through Barry
Plaza Seventh Plat, subdivisions in Kansas City, Platte County, Missouri.
hereby approved, subject to the following conditions:
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
the developer secure a land disturbance permit from the Department of Public
Works prior to beginning any construction, grading, clearing or grubbing
activities, if the disturbed area exceeds one acre.
the developer secure a land disturbance permit from the Missouri Department of
the developer extend water mains as required by the Water Services Department.
the developer construct hard surface all-weather roads and provide fire
protection as required by the Fire Department prior to construction beyond
the developer extend sanitary sewers as required by the Department of Public
the developer continue to work with the Park Hill School District and concerned
neighbors to address traffic, berming and landscaping issues prior to the
submittal of the final plan.
the developer receive the approval of the Board of Zoning Adjustment for a
variance to the required setback of 10 feet for the proposed tenant sign for
Building A3 (if needed) as shown on the development plan.
the developer submit a final plan to the City Plan Commission for approval, including
plans for grading, landscaping, building elevations, berming, screening and
copy of said amendment is on file in the office of the City Clerk under
Document No. 030304, which is attached hereto and made a part hereof.
B. That the Council finds and declares that before taking any action on the
proposed amendment hereinabove, all public notices and hearings required by the
Zoning Ordinance have been given and had.
hereby certify that as required by Chapter 80, Code of Ordinances, the
foregoing ordinance was duly advertised and public hearings were held.
