ORDINANCE NO. 951253
Amending Chapter 65, Revised Ordinances of Kansas City,
Missouri, 1956, commonly known as the Zoning Ordinance, by adding a new section
to be known as Section 65.010A2603, rezoning an area of approximately 46 acres
generally located at the northeast and southeast corners of N. Woodland Avenue
and proposed Shoal Creek Parkway from District RA (Agricultural) to District
CP-2 (Local Planned Business Center), and approving a preliminary plan for the
same. (11659-CP)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 65, Revised Ordinances of
Kansas City, Missouri, 1956, commonly known as the Zoning Ordinance, is hereby
amended by enacting a new section to be known as Section 65.010A2603, rezoning
an area of approximately 46 acres generally located at the northeast and
southeast corners of N. Woodland Avenue and proposed Shoal Creek Parkway from
District RA (Agricultural) to District CP-2 (Local Planned Business Center),
said section to read as follows:
Section 65.010A2603. That an area legally described
as:
All that part of the Northeast Quarter and all that
part of the Southeast Quarter of Section 25, Township 52, Range 32, Kansas
City, Clay County, Missouri, being bounded and described as follows:
Beginning at the southwest corner of said Northeast Quarter; thence North
0 42'59" East, along the west line of said Northeast Quarter, 1590.40
feet; thence South 89 17'01" East, 676.84 feet; thence South 35
56'05" East, 396.72 feet; thence South 0 00'00" East, 1234.16 feet;
thence southwesterly, along a curve to the left, having an initial tangent
bearing of South 51 56'58" West, a radius of 325.00 feet, an arc
distance of 109.57 feet; thence South 32 37'57" West, 608.38 feet;
thence southerly, along a curve to the left, tangent to the last described
course, having a radius of 725.00 feet, an arc distance of 327.59 feet;
thence North 89 16'10" West, 429.71 feet to a point in the west line of
said Southeast Quarter; thence North 0 43'50" East, along said west
line, 866.99 feet to the point of beginning. Containing 45.14 acres, more
or less, except that part on the west being used for road right-of-way.
is hereby rezoned from District RA (Agricultural) to
District CP-2 (Local Planned Business Center), all as shown outlined on a map
marked Section 65.010A2603, which is attached hereto and made a part hereof,
and which is hereby adopted as a part of an amendment to the zoning maps
constituting a part of said chapter and as an amendment to Section 65.010
thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved, subject to the following conditions:
1. That the developer cause the area to be platted
and processed in accordance with Chapter 66, Code of Ordinances of
the City of Kansas City, Missouri, as amended,
commonly known as the Subdivision Regulations.
2. That the developer submit a storm drainage
study for the entire development to the City Engineer's Office for
approval when the first plat is submitted and that the
developer make any improvements as required by
the City Engineer's Office.
3. That the developer submit plans for grading and
siltation and erosion control to the City Engineer's Office for
approval prior to the commencement of any construction
activities.
4. That the developer dedicate right of way for N.
Woodland as required by the Department of Public Works so as to
provide 75 feet of right of way as measured
from the centerline of N. Woodland including
dedication of right of way along the
Mo-Pub substation frontage.
5. That the developer improve one-half of N.
Woodland to parkway street standards, including improvement of N.
Woodland along the Mo-Pub substation frontage.
6. That the developer dedicate 100 feet of right
of way for Shoal Creek Parkway as required by the Department of
Public Works so as to provide 100 feet of right of way
from the centerline of each side of Shoal Creek
Parkway which abuts the
development.
7. That the developer grade full width right of
way and construct two lanes to parkway street standards for Shoal
Creek Parkway.
8. That the developer submit a street name sign
plan for approval and receive approval of the Street Naming Committee
for all street names.
9. That the developer construct temporary
cul-de-sacs as required by the City Engineer's Office.
10. That the developer submit a traffic study to
the City Engineer's Office for approval and that the developer make
any improvements as required by the approved traffic
study.
11. That the developer extend water mains as
required by the Water Services Department.
12. That the developer extend sanitary sewers as
required by the Water Services Department.
13. That the developer provide fire protection as
required by the Fire Department.
14. That the developer secure a land disturbance
permit from the Missouri Department of Natural Resources if the
disturbed area for the entire development exceeds five
acres.
15. That the developer comply with the height
restrictions of the KCI Airport height zoning map.
16. That the developer submit a final plan to the
City Plan Commission for approval for each stage of development. The
final plan shall include: site plan; dimension plan;
grading plan; landscape plan; and signage plan.
A copy of said preliminary plan is on file in the office
of the City Clerk under Document No. 951253, which is attached hereto and made
a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
