ORDINANCE NO. 961400

 

Approving an amendment to a previously approved preliminary plan in District M-P (Planned Industrial) on approximately a 50.2 acre tract of land generally located at the southeast corner of N.W. Barry Road and N. Baughman Road. (6733-MP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved preliminary plan in District M-P (Planned Industrial) on approximately a 50.2 acre tract of land generally located at the southeast corner of N.W. Barry Road and N. Baughman Road, and more specifically described as follows:

 

The west 50 feet of Lot 5, Block 2, of the Original Town of Barry, a subdivision of land in Kansas City, Clay County, Missouri, also a tract of land in the Southwest Fractional Quarter of Section 10, Township 51, Range 33, Kansas City, Clay and Platte Counties, Missouri, described as follows: Beginning at the southwest corner of Lot 5, Block 2, Original Town of Barry, thence South 89 32'37" East along the south line of Original Town of Barry, a distance of 50 feet, thence deflecting right at an angle of 89 40' from the last described course a distance of 200 feet, thence deflecting right at an angle of 90 20' from the last described course, a distance of 50 feet, thence deflecting left at an angle of 90 20' from the last described course a distance of 848 feet, thence deflecting left at an angle of 89 40' from the last described course a distance of 500 feet, thence deflecting right at an angle of 89 40' from the last described course a distance of 1402.98 feet to the south line of said Southwest Fractional Quarter of said Section 10, thence west along the south line of said Southwest Fractional Quarter of said Section 10, a distance of 1045 feet to the east line of Baughman Road, as now established, thence North 0 06'23" East along the east line of Baughman Road, a distance of 990.85 feet, thence northerly along the east line of said Baughman Road on a curve to the left, having a radius of 1175.92 feet, a distance of 315.42 feet, thence North 15 15'44" West along the east line of said Baughman Road, a distance of 457.51 feet, thence northerly along the east line of Baughman Road on a curve to the right, having a radius of 379.26 feet, a distance of 264.11 feet, thence North 24 38'16" East along the east line of said Baughman Road a distance of 130.21 feet, thence northerly along the east line of said Baughman Road on a curve to the left having a radius of 316.48 feet, a distance of 135.50 feet, thence North 0 06'23" East along the east line of said Baughman Road a distance of 204.67 feet, thence east along the south line of Blocks 1 and 2 of the Original Town of Barry, a distance of 605 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a final plan for the tower site to the City Plan Commission for approval, including an elevation of the tower referencing building materials,

textures and colors, a lighting ring chart, and a landscaping plan.

 

3. That the developer install the previously approved white pine landscaping prior to the commencement of any construction activities.

 

4. That the developer secure any necessary approvals from the Federal Aviation Administration prior to the issuance of any required City permits.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 961400, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
