ORDINANCE NO. 180472

 

Authorizing the City Manager to execute a Dedication and Development Agreement between the City, the Tax Increment Financing Commission of Kansas City, Missouri, and Tiffany Land Reserve, LLC, a Missouri limited liability company.

 

WHEREAS, pursuant to the Real Property Tax Increment Allocation Redevelopment Act, Sections 99.800 to 99.865, RSMo, as amended (the “TIF Act”), the City Council of Kansas City, Missouri (the “City Council”) by Ordinance No. 54556 passed on November 24, 1982, and thereafter repealed and amended in certain respects by Committee Substitute for Ordinance No. 911076, As Amended, passed on August 29, 1991, Ordinance No. 100089, passed on January 28, 2010, Ordinance No. 130986, passed on December 19, 2013, and Committee Substitute for Ordinance No. 140823, As Amended, passed on June 18, 2015, created the Tax Increment Financing Commission of Kansas City, Missouri (the “Commission”); and

 

WHEREAS, the City Council accepted the recommendations of the Commission, approved the KCI Corridor Tax Increment Financing Plan (the “Plan”) and designated a Redevelopment Area in Ordinance No. 990256; and 

 

WHEREAS, the City Council, by its passage of a series of ordinances, has amended the Redevelopment Plan on numerous occasions since it was first approved which included improvements to ; and

 

WHEREAS, the Plan provides for, among other things, the improvement of certain roadways and infrastructure within and adjacent to the Redevelopment Area, including a right-of-way extension of N.W. Skyview Avenue from N. Ambassador Drive to N.W. Old Tiffany Springs Road on a portion of property owned by Land Reserve LLC; and

 

WHEREAS, the Plan budget provides that traffic signals be installed at N.W. Skyview Avenue and N. Ambassador Drive and at N.W. Skyview Avenue and N.W. Old Tiffany Springs Road, subject to certain conditions, and provides that the warrants established by the Manual on Uniform Traffic Control Devices are satisfied; and

 

WHEREAS, this Dedication and Development Agreement will outline the respective obligations and duties of Tiffany Land Reserve, LLC, the City, and the TIF Commission subject to the terms and conditions of this Agreement in order to complete the construction of N.W. Skyview Avenue from N. Ambassador Drive to N.W. Old Tiffany Springs Road in 2019; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 


 

Section 1. That the City Manager is hereby authorized to execute a Dedication and Development Agreement between the City, the Tax Increment Financing Commission of Kansas City, Missouri, and Tiffany Land Reserve, LLC, a Missouri limited liability company related to the KCI Corridor TIF Plan and improvements to N.W. Skyview Avenue from N. Ambassador Drive to N.W. Old Tiffany Springs Road.  A copy of the agreement is on file in the office of the City Manager.
