ORDINANCE NO. 150153

 

Approving a development plan in District M 1-5 on approximately a 38 acre tract of land generally located at the southeast corner of Missouri State Highway No. 150 and Andrews Road. (14049-P-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District M 1-5 (Manufacturing 1-5) to allow for an industrial building containing about 450,000 square feet generally located at the southeast corner of Missouri State Highway No. 150 and Andrews Road, and more specifically described as follows:

A tract of land in the Northeast Quarter of Section 35, Township 47 North, Range 33 West of the 5th Principal Meridian in Kansas City, Jackson County, Missouri being bounded and described as follows: Commencing at the Northwest corner of said Northeast Quarter; thence South 86 degrees 18 minutes 57 seconds East, along the North line of said Northeast Quarter, 602.45 feet; thence South 03 degrees 41 minutes 03 seconds West, 163.36 feet to a point on the North right-of-way line of Missouri State Highway 150, as now established, said point also being the point of beginning of the tract of land to be herein described; thence North 84 degrees 39 minutes 29 seconds East, along said North right-of-way line, 419.36 feet; thence South 68 degrees 18 minutes 20 seconds East, continuing along said North right-of-way line, 157.84 feet; thence South 86 degrees 17 minutes 19 seconds East, continuing along said North right-of-way line, 131.23 feet; thence North 82 degrees 07 minutes 35 seconds East, continuing along said North right-of-way line, 133.96 feet; thence South 86 degrees 17 minutes 19 seconds East, continuing along said North right-of-way line, 164.04 feet; thence North 85 degrees 39 minutes 50 seconds East, continuing along said North right-of-way line, 61.13 feet to a point on the West line of the St. Louis and San Francisco Railroad as now established; thence South 03 degrees 36 minutes 59 seconds West (departing aforesaid Southerly right of way line) along the West line of said St. Louis and San Francisco Railroad, 1116.44 feet; thence North 86 degrees 23 minutes 01 seconds West, 50.00 feet to a point 40.00 feet Northwesterly of the centerline of a railroad spur track, as now established; thence Southwesterly along a curve to the right, parallel with and 40.00 feet distant from said centerline, with an initial tangent bearing of South 28 degrees 48 minutes 06 seconds West, having a radius of 1472.69 feet, a central angle of 33 degrees 03 minutes 07 seconds and an arc distance of 849.54 feet; thence North 28 degrees 08 minutes 46 seconds West, 146.04 feet; thence North 86 degrees 18 minutes 57 seconds West, 391.29 feet; thence North 41 degrees 52 minutes 20 seconds West, 232.03 feet to a point on the East right-of-way line of Andrews Road, as now established; thence Northeasterly, along said East right-of-way line, on a curve to the left, having an initial tangent bearing of North 46 degrees 31 minutes 16 seconds East with a radius of 535.00 feet, a central angle of 38 degrees 52 minutes 22 seconds and an arc distance of 362.98 feet; thence North 07 degrees 38 minutes 54 seconds East, continuing along said East right-of-way line, 638.55 feet; thence Northerly, continuing along said East right-of-way line, on a curve to the left being tangent to the last described course with a radius of 1,035.00 feet, a central angle of 03 degrees 57 minutes 51 seconds and an arc distance of 71.61 feet; thence North 03 degrees 41 minutes 03 seconds East, continuing along said East right-of-way line, 368.48 feet to the point of beginning. Containing 1,656,669 square feet or 38.03 acres, more or less.

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

2. That the developer submit a detailed micro storm drainage study showing compliance with the approved and most current macro study on file with the City and with current adopted standards in effect at the time of submission, including a detailed analysis and design of the permanent Water Quantity and Quality BMP's, conveyance systems, and sewer services, prior to approval and issuance of any building permits to construct improvements on the site; that the developer verify and/or improve downstream conveyance systems or address solutions for impacted properties due to flow contributions from the site; and that the developer construct any other improvements as required by Land Development Division as necessary to mitigate impacts from rate, volume, and quality of runoff from each proposed phase.

 

3. That the developer grant on City approved forms, BMP Easements to the City, as required by Chapter 88 and the Land Development Division, prior to issuance of any building permits or BMP permits, whichever occurs first.

 

4. That the developer submit a letter to the Land Development Division from a licensed civil engineer, licensed architect, or licensed landscape architect, who is registered in the State of Missouri, identifying sidewalks, curbs, and gutters in disrepair as defined by Public Works Department's "OUT OF REPAIR CRITERIA FOR SIDEWALK, DRIVEWAY AND CURB revised 4/8/09" and based on compliance with Chapters 56 and 64, Code of Ordinances, for the sidewalks, curbs, and gutters where said letter shall identify the quantity and location of sidewalks, curbs, and gutters that need to be constructed, repaired, or reconstructed to remedy deficiencies and/or to remove existing approaches no longer needed by this project. The developer shall secure permits to repair or reconstruct the identified sidewalks, curbs, and gutters as necessary along all development street frontages as required by the Land Development Division and prior to issuance of any certificate of occupancy permits including temporary certificate occupancy permits.

 

5. That the developer pay impact fees as required by Chapter 39 of the City's Code of Ordinances as required by the Land Development Division.

 

6. That the developer obtain the executed and recorded City approved grading, temporary construction, drainage/sewer, or any other necessary easements from the abutting property owner(s) that may be required prior to submitting any public improvements crossing properties not controlled by the developer and include said document(s) within the public improvement applications submitted for permitting.

 

7. That the owner/developer submit plans for grading, siltation, and erosion control to Land Development Division for review, acceptance, and permitting for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

8. That the owner/developer secure a site disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

9. That the developer verify sight distance for the Andrews Road drive connection improvements to ensure local jurisdiction and/or minimum AASHTO adequate sight distance standards are met.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
