ORDINANCE NO. 110642

 

Declaring it necessary to establish or change and reestablish the grades of, and the relocation, opening, establishing and dedicating of Street Right of Way on N. W. 96th Street and N.W. 108th Street and connecting streets, N. Holly Street, N. Summit Street, N. Northbrooke Drive, N. Main Street, N. Walnut Street, N. Grand Avenue, N. McGee Street, N. Kenwood Street, N. Holmes Street, and N. Campbell Street, all in Kansas City, Clay County, Missouri; and directing the City Clerk to cause a notice to be published as provided for herein.

 

WHEREAS, the Council approved Ordinance Nos. 110171 and 110544 which authorized agreements with the Missouri Department of Transportation for the construction of interchanges on US 169; and

 

WHEREAS, the construction of the interchanges will improve sections of N.W. 96th Street and N.W. 108th Street and connecting streets, N. Holly Street, N. Summit Street, N. Northbrooke Drive, N. Main Street, N. Walnut Street, N. Grand Avenue, N. McGee Street, N. Kenwood Street, N. Holmes Street, and N. Campbell Street; and

 

WHEREAS, the Council finds that for the public good it is necessary that the grades on N.W. 96th Street and N.W. 108th Street and connecting streets, N. Holly Street, N. Summit Street, N. Northbrooke Drive, N. Main Street, N. Walnut Street, N. Grand Avenue, N. McGee Street, N. Kenwood Street, N. Holmes Street, and N. Campbell Street, be changed and reestablished; and

 

WHEREAS, the Council further finds that for the public good it is necessary to relocate, open, establish and dedicate street right of way on N.W. 96th Street and N.W. 108th Street and connecting streets, all in Kansas City, Clay County, Missouri; and

 

WHEREAS, the Council further finds the Director of Public Works, as evidenced by his issuing a Declaration of Necessity, No. 5485 has caused the plans and specifications for Project No. 89008191, N.W. 108th Street, Street and Storm Improvements, to be prepared, and as evidenced by his issuing a Declaration of Necessity, No. 5502, has caused the plans and specifications for Project No. 89008141, N.W. 96th Street, Street and Storm Improvements to be prepared; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council finds and declares it necessary to change and reestablish the grades on N.W. 96th Street which shall be constructed as a four lane parkway without bike lanes, from N. Jefferson to N. Oak Trafficway and N.W. 108th Street which shall be constructed as a four lane parkway without bike lanes, from N. Holly to N. Oak Trafficway, and the connections of N. Holly Street, N. Summit Street, N. Northbrooke Drive, N. Main Street, N. Walnut Street, N. Grand Avenue, N. McGee Street, N. Kenwood Street, N. Holmes Street, and N. Campbell Street to N.W. 108th Street, all in Kansas City, Clay County, Missouri; with the following described centerlines, as follows, to wit:

 

N.W. 96th Street (Future Tiffany Springs Parkway): A description of the centerline of Northeast 96th Street lying in the Southeast Quarter of Section 34, the Southwest Quarter of Section 35, and the Northwest Quarter of Section 02 all being in Township 52 North, Range 33 West, of the 5th Principal Meridian in Kansas City, Clay County, Missouri, being more particularly described as follows:

 

Commencing at the Southwest corner of the Southeast Quarter of 34; thence a line on a bearing North 60 degrees 41 minutes 47.04 seconds East of the Southwest corner for a distance of 1,611.04 feet to a Point of Beginning of said centerline having a stationing of 15+55.69; thence North 88 degrees 49 minutes 50.97 seconds East, 1,843.23 feet, thence Southeasterly, along a curve to the right, being tangent to the last described course, with a radius of 1,145.92 feet, a central angle of 44 degrees 39 minutes 03.00" and an arc distance of 893.02 feet, thence South 46 degrees 31 minutes 06.03" East, 496.67 feet, thence Southeasterly, along a curve to the left, being tangent to the last described course, with a radius of 750.00 feet, a central angle of 43 degrees 01 minutes 17.82 seconds and an arc distance 563.15 feet, thence South 89 degrees 32 minutes 23.86" East, 463.05 feet to the centerline of North Oak Trafficway, as now established, said point being the Point of Terminus.

 

N.W. 108th Street west of North Oak towards Holly (future Shoal Creek Parkway): Commencing at the SW Corner of the Northeast Quarter of Section 27 Range 52 West Township 33 North; thence from the Point of Commencing North 89 degrees 35 minutes 47 seconds West, a distance of 311.13 feet to the Point of Beginning; thence from the Point of Beginning South 89 degrees 57 minutes 12 seconds East, a distance of 192.57 feet; thence North 88 degrees 52 minutes 23 seconds East, a distance of 88.60; thence North 88 degrees 27 minutes 53 seconds East, a distance of 30.05 feet; thence along a curve to the left having a radius of 1000.00 feet, a central angle of 9 degrees 33 minutes 59 seconds, and a distance of 166.96 feet; thence along a curve to the right having a radius of 1000.00 feet, a central angle of 11 degrees 37 minutes 51seconds, and a distance of 203.00 feet; thence South 89 degrees 28 minutes 14 seconds East, a distance of 1208.81 feet; thence along a curve to the right having a radius of 1500.00 feet, a central angle of 3 degrees 49 minutes 11seconds, and a distance of 222.61 feet; thence along a curve to the left having a radius of 1000.00 feet, a central angle of 8 degrees 54 minutes 40 seconds, and a distance of 155.53 feet; thence South 89 degrees 52 minutes 43 seconds East, a distance of 999.93 feet; thence along a curve to the left having a radius of 1000.00 feet, a central angle of 14 degrees 45 minutes 02 seconds, a distance of 257.45 feet; thence on a curve to the right having a radius of 1500.00 feet, a central angle of 15 degrees 03 minutes 32 seconds, a distance of 394.24 feet; thence South 89 degrees 34 minutes 13 seconds, a distance of 1096.27 feet; thence along a curve to the right having a radius of 1500.00 feet, a central angle of 12 degrees 02 minutes 26 seconds, a distance of 315.22 feet; thence on a curve to the left having a radius of 1000.00 feet, a central angle of 5 degrees 43 minutes 46 seconds, a distance of 210.15 feet; thence South 89 degrees 34 minutes 13 seconds East, a distance of 61.86 feet.

 

Westbound N.W. 108th Street east of North Oak towards Harrison (future Shoal Creek Parkway): Commencing at the Southwest Corner of the Northeast Quarter of Section 26 Range 52 West Township 33 North; thence from the Point of Commencing North 00 degrees 32 minutes 32 seconds East, along the West line of said Northeast Quarter, a distance of 88.16 feet; thence South 89 degrees 27 minutes 28 seconds East, a distance of 14.53 feet to the Point of Beginning, said point being Station 158+35.12 on the Proposed Westbound Shoal Creek Parkway; thence from the Point of Beginning South 89 degrees 27 minutes 28 seconds East, a distance of 843.59 feet; thence along a curve to the right having a radius of 1500.00 feet, a central angle of 8 degrees 33 minutes 59 seconds, a distance of 224.27 feet; thence South 80 degrees 53 minutes 29 seconds East, a distance of 369.90 feet; thence along a curve to the left having a radius of 1500.00 feet; a central angle of 13 degrees 41 minutes 14 seconds, and a distance of 358.33 feet; thence North 85 degrees 25 minutes 17 seconds East, a distance of 73.06 feet; thence along a curve to the right having a radius of 1500.00 feet, a central angle of 5 degrees 01 minutes 15 seconds, a distance of 131.45 feet; thence South 89 degrees 26 minutes 51 seconds East, a distance of 482.12 feet, to a point of termination.

 

Eastbound N.W. 108th Street east of North Oak towards Harrison (future Shoal Creek Parkway): Commencing at the SW Corner of the Northeast Quarter of Section 26 Range 52 West Township 33 North; thence from the Point of Commencing North 00 degrees 32 minutes 32 seconds East, along the West line of said Northeast Quarter, a distance of 18.44 feet to the Point of Beginning, said point being Station 158+35.12 on the Proposed Eastbound Shoal Creek Parkway; thence from the Point of Beginning South 89 degrees 27 minutes 28 seconds East, a distance of 849.90 feet; thence along a curve to the right having a radius of 1500.00 feet, a central angle of 8 degrees 33minutes 59 seconds, a distance of 224.27 feet; thence South 80 degrees 53 minutes 29 seconds East, a distance of 666.26 feet; thence along a curve to the left having a radius 1500.00 feet, a central angle of 8 degrees 39 minutes 55 seconds, a distance of 226.86 feet; thence South 89 degrees 33 minutes 24 seconds East, a distance of 519.72 feet, to a point of termination.

 

Section 2. That the Council hereby directs that the City Clerk cause a notice of said grade changes to be published in the newspaper doing the city printing, on each day of issue of said newspaper for a period of ten (10) days, starting on or about the date following the passage of this ordinance, and providing a period of thirty (30) days for remonstrance starting the same day as the first day of the publication.

 

Section 3. That grades shall be of the nature described and specified in, and shall be done in accordance with the plans and specifications prepared by the Missouri Department of Transportation under the supervision of the Director of Public Works and identified as KCMO Project Numbers 89008141, N.W. 96th Street, Street and Storm Improvements and 89008191, N.W. 108th Street, Street and Storm Improvements, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

 

Section 4. That the width of the right of way of N.W. 96th Street and N.W. 108th Street and connecting streets, as shown on the plans described in Section 3 of this ordinance, are hereby relocated, opened, established and dedicated as shown on said plans.

 

Section 5. That changing and reestablishing grades on N.W. 96th Street and N.W. 108th Street and connecting streets, is hereby authorized to commence when this ordinance becomes effective, and shall be built in accordance with the plans and specifications as described in Section 3 of this ordinance; locating and defining the grade points of said streets on the proposed project baseline stationing as found on said plans, said grade points being connected by straight grades (tangents) or vertical curves between such grade points, the elevations of which are herein given below in feet (NAVD88 directrix), along with other pertinent alignments data, to-wit:
