ORDINANCE NO. 030429

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0478, rezoning an area of approximately 3.91 acres generally located at the southwest corner of N. Brighton Avenue and N.E. 80th Street from District RA (Agricultural) to District CP-1 (Neighborhood Planned Business Center), and approving a development plan for the same. (12542-CP-5)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0478, rezoning an area of approximately 3.91 acres generally located at the southwest corner of N. Brighton Avenue and N.E. 80th Street from District RA (Agricultural) to District CP-1 (Neighborhood Planned Business Center), said section to read as follows:

 

Section 80-11A0478. That an area legally described as:

 

A tract of land located in Section 17, Township 51, Range 32, in Kansas City, Clay County, Missouri, more particularly described as follows: Beginning at the northeast corner of the Northwest Quarter of Section 17, Township 51, Range 32, in Kansas City, Clay County, Missouri; thence North 88E57'57" West, a distance of 30.00 feet to the true point of beginning; thence South 00E48'37" West, a distance of 323.22 feet to a point; thence North 89E34'23" West, a distance of 408.21 feet to a point; thence North 00E44'01" East, a distance of 443.36 feet to a point; thence South 89E27'54" East, a distance of 408.16 feet to a point; thence South 00E30'27" West, a distance of 119.35 feet to the point of beginning; containing 3.91 acres or 170320.92 square feet, more or less.

 

is hereby rezoned from District RA (Agricultural) to District CP-1 (Neighborhood Planned Business Center), all as shown outlined on a map marked Section 80-11A0478, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval when the final plat is submitted and that the developer make any necessary improvements as required by the City Engineers


Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend sanitary sewers as required by the Department of Public Works.

 

8. That the developer extend water mains as required by the Water Services Department.

 

9. That the developer construct a right turn lane on N.E. 80th Street to the entrance drive and reconstruct sidewalks as required by the Department of Public Works.

 

10. That the developer dedicate additional right of way on the west side of N. Brighton Avenue as required by the Department of Public Works so as to provide a total of 50 feet of right of way as measured from the centerline on the west side of N. Brighton Avenue.

 

11. That the developer improve the west half of N. Brighton Avenue to primary arterial street standards as required by the Department of Public Works, including construction of curb, gutter and sidewalks and installation of streetlights.

 

12. That the developer enter into an agreement with the City as required by the Department of Public Works whereby the developer agrees to contribute 25% of the cost, not to exceed a maximum cost of $37,500.00, for installing traffic signals at the intersection of N. Brighton Avenue and N.E. 80th Street at the time the first final plat is submitted.

 

13. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

14. That the developer show the limits of the floodplain on the final plat as required by the Department of Public Works.

 

15. That the developer submit a final plan to the City Plan Commission for approval, including plans for building materials and elevation, signage, lighting, grading and landscaping.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 030429, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
