ORDINANCE NO. 970867

 

Approving an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 2.35 acre tract of land generally located at the northwest corner of N.W. 87th Terrace and N. Amity Avenue. (11066-GP-3)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a previously approved development plan in District GP-3 (Regional Business) on approximately a 2.35 acre tract of land generally located at the northwest corner of N.W. 87th Terrace and N. Amity Avenue, and more specifically described as follows:

 

All that part of the Northwest Quarter of Section 11, Township 51, Range 34, Kansas City, Platte County, Missouri, described as follows: Commencing at the northeast corner of the Northwest Quarter of said Section 11; thence South 0 35'17" East along the east line of the Northwest Quarter of said Section 11, a distance of 551.74 feet; thence South 89 24'43" West, 134.89 feet to a point 155.00 feet west of Station 114+75 on the centerline of N. Amity Road, said point being the point of beginning of the tract of land herein to be described; thence South 11 53'48" East along the westerly line of the right of way of said N. Amity Road, a distance of 248.18 feet; thence North 89 05'39" West, a distance of 150.89 feet; thence westerly along a curve to the left, having the last described course as a tangent, having a radius of 415.84 feet, an arc distance of 159.67 feet; thence South 68 54'21" West, a distance of 113.31 feet; thence North 21 05'39" West, a distance of 90.00 feet; thence North 15 20'56" East, a distance of 256.14 feet to a point on the southerly line of the right of way of Missouri State Highway No. 152; thence South 74 39'04" East along said southerly right of way line, a distance of 77.23 feet; thence South 89 39'49" East along said southerly right of way line, a distance of 251.78 feet to the point of beginning. The above described tract of land contains 2.35 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineer's Office for approval and that the developer make any improvements as required by the City

Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer extend water mains as required by the Water Services Department.

 

5. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer dedicate right of way for N. Amity Avenue as required by the Department of Public Works so as to provide 50 feet of right of way as measured

from the centerline of N. Amity Avenue.

 

8. That the developer improve the west half of N. Amity Avenue to primary arterial street standards as required by the Department of Public Works including curbs,

gutters and sidewalks.

 

9. That the developer improve the north half of N.W. 87th Terrace to collector street standards as required by the Department of Public Works including curbs, gutters and

sidewalks.

 

10. That the developer secure the approval of the Missouri Highway and Transportation Department prior to working in any State right of way.

 

11. That the developer grant a Noise and Aviation Easement to the City as required by the Department of Public Works.

 

12. That the developer show the limits of the 100 year floodplain on the final plat as required by the Department of Public Works.

 

13. That the developer submit a final signage plan for the sign which is shown on the development plan to the Department of City Development for approval prior to the

issuance of a building permit.

 

A copy of said amendment is on file in the office of the City Clerk under Document No. 970867, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
