COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140940

 

Under certain circumstances, waiving the requirement that a company must be a licensed demolition contractor to demolish properties owned by the Land Bank of Kansas City, Missouri; and directing the Director of Neighborhoods and Housing Services and the Land Bank to report back to the Council.

 

WHEREAS, the City previously contracted for, and has completed the required asbestos removal on various Land Bank properties that have been declared dangerous structures; and

 

WHEREAS, the City has identified five initial properties owned by Land Bank that need demolition of the structures which are 2008 E 82nd Terrace, 8113 Highland, 8320 Wayne, 8309 Flora, and 8109 Highland; and

 

WHEREAS, the Neighborhoods and Housing Services Department and Land Bank wish to create a policy for a program for the donation of services by qualified donors to demolish structures, and in proceeding with these initial five properties, the Neighborhoods and Housing Services Department and Land Bank will use the demolition of the five properties to create such policy and program; and

 

WHEREAS, a private company that has experience in demolition work has offered to demolish the dangerous structures without cost to the City as civic philanthropy, resulting in the removal of dangerous buildings that are a blight and nuisance to the City and its neighborhoods; and

 

WHEREAS, the Neighborhood Preservation—Dangerous Buildings Division of the Neighborhoods and Housing Services Department will oversee the demolition of the dangerous structures and will report and address any concerns with the private contractor that is demolishing the dangerous structures; and

 

WHEREAS, the private contractor shall maintain the standard amount of liability insurance with the City as an additional insured and obtain the necessary permits in conjunction with the City to demolish the dangerous structures; and

 

WHEREAS, the Land Bank of Kansas City, MO is in agreement that the structures are dangerous and are a nuisance and blight to the surrounding neighborhood and is supportive of the private company demolishing the dangerous structures; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Notwithstanding Section 18-4(j), Code of Ordinances, the City may contract with a private company that has experience in demolition work to demolish Land Bank properties at 2008 E 82nd Terrace, 8113 Highland, 8320 Wayne, 8309 Flora, and 8109 Highland, if the asbestos has previously been removed, without that private company having a current demolition license, if the demolition is without cost to the City.

 

Section 2. That the Director of Neighborhoods and Housing Services and the Land Bank are directed to evaluate the experience gained from the project involving the five aforementioned properties and shall return to the Council with a policy and recommendations for future similar projects.
