ORDINANCE NO. 140538

 

Authorizing the City Attorney to execute and file such pleadings and documents as may be required to establish a port improvement district to assess a 1% sales and use tax and a property tax upon the Berkley Riverfront property, for the purposes of generating revenue to pay the costs of infrastructure required to facilitate the development of the Berkley Riverfront property.

 

WHEREAS, the Port Authority of Kansas City, Missouri (the "Authority") owns certain real property along the Missouri River west of the Christopher S. Bond Bridge (the “Port Authority Property”); and

 

WHEREAS, the Authority has developed a master planned development for the Port Authority Property (the “Berkley Riverfront Plan”) that requires the construction of certain infrastructure and supportive facilities; and

 

WHEREAS, the Authority has determined it is in the best interest of the Authority and the Berkley Riverfront Plan to create a Port Improvement District (the "PID") pursuant to Port Improvement District Act, Sections 68.200, RSMo, et seq., as amended (the “PID Act”), for the purposes of imposing a 1.0% percent sales and use tax and a property tax on the Berkley Riverfront Property (the “PID Tax”) under the respective provisions of Section 68.235.1 and 68.245.1, RSMo, as amended, with certain exceptions listed in Section 68.245.1 of the PID Act, so the PID Tax revenues may be applied by the Authority to the infrastructure costs related to implementation of the Berkley Riverfront Plan; and

 

WHEREAS, the City is a statutory respondent to the Authority’s petition to establish a PID; and

 

WHEREAS, in furtherance of the Berkley Riverfront Plan, the Authority desires the City, as a statutory respondent under Section 68.235.1 and 68.245.1, RSMo, as amended, to execute and file such pleadings as may be required to establish a PID to assess a 1% sales and use tax and a property tax upon the Berkley Riverfront property, for the purposes of generating revenue to provide funding for obligations related to the implementation of the Berkley Riverfront Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1.  That the Council does hereby authorize and direct the City Attorney to execute such pleadings and documents and make such filings on behalf of the City as may be required to establish the PID.
