ORDINANCE NO. 130900

 

Establishing and dedicating a portion of City-owned real estate for public right of way, grading and storm drainage purposes north of, adjacent to and as part of vacated 87th Street, all in Kansas City, Jackson County, Missouri; and directing the City Clerk to record this ordinance in the Recorder’s Office in Jackson County, Missouri.

 

WHEREAS, City-owned real estate is now vacant land that was acquired as part of project number 89008037- 87th Street Improvement; and

 

WHEREAS, City-owned real estate located in part of the Southeast Quarter of Section 23, Township 48, Range 33 West is needed for public right of way, grading and storm drainage purposes; and

 

WHEREAS, the council finds that it is necessary to establish and dedicate City-owned real estate for public right of way, grading and storm drainage purposes for future development of property and for the public good; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. Grading. Kansas City shall use the hereinafter described area for the right to change the grade of the land and to establish slopes and cutbacks adjacent to the already established road right-of-way and to keep and maintain the slope and cutbacks, in connection with 87th Street.

 

Section 2. Storm Drainage. Kansas City shall use the described area for storm water drainage including the right to build, construct, keep and maintain storm water drainage facilities under, in, over, and upon the described tract, and shall have the right at all times to go upon the lands herein described to construct, maintain and repair the said drainage facilities as may be necessary.

 

Section 3. That the City hereby establishes the city-owned real estate hereinafter described for public right of way, grading and storm drainage purposes:

 

The following descriptions which are being described as part of 87th Street right of way, grading easement, and storm drainage easement are from and related to the following defined centerline along redesigned 87th Street located in Sections 22 and 23, Township 48 North, Range 33 West, in Kansas City, Jackson County, Missouri, all bearings are referenced to grid north of the Missouri State Plane Coordinate System, 1983, West Zone, and also found in plans for 87th Street project number 89008037, which are filed in the Public Works Department; said center line being more particularly described as follows:

 

Commencing at a found #3 Iron Bar at the Northwest corner of the Northeast quarter of Section 22, Township 48 North, Range 33 West; thence South 02 degrees 15 minutes 34 seconds, West along the west line of said Northeast quarter of Section 22, a distance of 787.15 feet; thence South 87 degrees 44 minutes 26 seconds, East along a line that is perpendicular to said west line, a distance of 1077.42 feet to the point of beginning of said defined line, being at Station 3+84.49; thence South 29 degrees 17 minutes 33 seconds, East, a distance of 631.29 feet to P.C. Station 10+15.78; thence on a curve to the left, tangent to the last described course, having a central angle of 28 degrees 05 minutes 37 seconds and a radius of 716.20 feet; thence Southeasterly along said curve to the left, an arc distance of 351.17 feet to P.T. Station 13+66.95; thence South 57 degrees 23 minutes 10 seconds, East, a distance of 1152.45 feet to Station 25+19.40, being a point on the west line of the Northwest quarter of Section 23, Township 48 North, Range 33 West; that bears North 02 degrees 20 minutes 24 seconds, East, a distance of 535.75 feet from the Southwest corner of the Northwest quarter of said Section 23; thence continuing South 57 degrees 23 minutes 10 seconds, East, along said defined line, a distance of 200.50 feet to P.C. Station 27+19.90 of a curve to the left, tangent to the last described course, having a central angle of 35 degrees 22 minutes 05 seconds and a radius of 2300.00 feet; thence easterly along said curve to the left, an arc distance of 1419.77 feet to P.T. Station 41+39.67; thence North 87 degrees 14 minutes 45 seconds, East, a distance of 256.00 feet to P.C. Station 43+95.67 of a curve to the right, tangent to the last described course, having a central angle of 20 degrees 19 minutes 13 seconds and a radius of 2300.00 feet; thence southeasterly along said curve to the right, an arc distance of 815.70 feet to P.T. Station 52+11.37; thence South 72 degrees 26 minutes 02 seconds, East, a distance of 49.04 feet to Station 52+60.41, being a point on the west line of the Northeast quarter of Section 23, Township 48 North, Range 33 West that bears North 02 degrees 13 minutes 41 seconds, East, a distance of 96.81 feet from the Southwest corner of the Northeast quarter of said Section 23; thence continuing South 72 degrees 26 minutes 02 seconds, East along said defined line, a distance of 206.96 feet to P.C. Station 54+67.37 of a curve to the left, tangent to the last described course, having a central angle of 14 degrees 30 minutes 59 seconds, a radius of 2300.00 feet and an arc distance of 582.73 feet; thence easterly along said curve to the left, from P.C. Station 54+67.37, through a central angle of 05 degrees 26 minutes 52 seconds for an arc distance of 218.69 feet to P.O.C. Station 56+86.06, being a point on the south line of the Northeast quarter of Section 23, Township 48 North, Range 33 West that bears South 86 degrees 59 minutes 06 seconds, East, a distance of 412.95 feet from the Southwest corner of the Northeast quarter of said Section 23; thence continuing easterly along said curve to the left, from P.O.C. Station 56+86.06, through a central angle of 09 degrees 04 minutes 07 seconds for an arc distance of 364.04 feet to P.T. Station 60+50.10; thence South 86 degrees 57 minutes 01 seconds, East, a distance of 1542.29 feet to the point of termination of said defined line at Station 75+92.39.

Beginning 122.13 feet left of Station 28+21.91; thence Northeasterly along a straight line, to a point 158.40 feet left of Station 28+47.96; thence Southeasterly along a straight line, to a point 98.05 feet left of Station 29+37.75; thence Southwesterly along a straight line, to a point 65.00 feet left of Station 29+12.64; thence Southeasterly along a non-tangent curve to the left, having a central angle of 01 degrees 07 minutes 28 seconds, a radius of 2235.00 feet, with a radius point bearing of North 27 degrees 48 minutes 46 seconds, East, for an arc length of 43.86 feet, to a point on the Northerly right-of-way line of 87th Street, at 65.00 feet left of Station 29+57.78; thence Westerly along said Northerly right-of-way line and along a non-tangent curve to the right, having a central angle of 15 degrees 41 minutes 23 seconds, a radius of 343.06 feet, with a radius point bearing of North 05 degrees 12 minutes 08 seconds, East, for an arc length of 93.94 feet, to a point on the Westerly line of the property described by Missouri Warranty Deed, Document Number B-377293, filed on May 4, 1961, at the Jackson County, Missouri, Recorder of Deeds Office, at 41.08 feet left of Station 28+65.09; thence Northerly along said Westerly line, to the point of beginning at 122.13 feet left of Station 28+21.91. Containing approximately 7,489.42 square feet.

Beginning at a point 65.00 left of Station 29+12.64; thence Northeasterly along a straight line to a point 98.05 feet left of Station 29+37.75; thence continuing Northeasterly along a straight line to a point 119.17 feet left of Station 29+51.13; thence Easterly along a straight line to a point 127.95 feet left of Station 30+69.28; thence Southwesterly along a straight line to a point 87.90 feet left of Station 30+07.80; thence Northerly along a straight line to a point 107.19 feet left of Station 30+07.87; thence Westerly along a straight line to a point 107.19 feet left of Station 29+92.13; thence Southerly along a straight line to a point 79.93 feet left of Station 29+92.23; thence Southwesterly along a straight line to a point 65.00 feet left of Station 29+57.78, said point also being on the north right of way line of East 87th Street, as now established; thence Westerly along said right of way line of 87th Street to the point of beginning 65.00 feet left of Station 29+12.64. Section 2. The property herein described shall be used by Kansas City for maintenance as part of existing 87th Street improvements and any necessary appurtenances; and Kansas City and its agents shall have the right to enter upon property for the purpose of constructing, reconstructing, maintaining, operating and repairing existing and future public improvements or making connections thereto. Any future owners of any portion of the above described property shall not use nor attempt to use said property in such a manner as would interfere with the proper, safe and continuous maintenance and use of said drainage facilities and specifically shall not build thereon or thereover any structure which may interfere with the maintenance and use thereof.

 

Section 3. That upon the effective date of this ordinance, the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Jackson County, Missouri.
