ORDINANCE NO. 961597

 

Amending Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding a new section to be known as Section 80-11A0010, rezoning an area of approximately 116.51 acres generally located on the north side of N.W. 88th Street, west of Green Hills Road, from Districts GP-5 (Medium Density Residential Uses) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density Residential Uses), and approving a development plan for the same. BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0010, rezoning an area of approximately 116.51 acres generally located on the north side of N.W. 88th Street, west of Green Hills Road, from Districts GP-5 (Medium Density Residential Uses) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density Residential Uses), said section to read as follows:

 

Section 80-11A0010. That an area legally described as:

 

A tract of land in the Southwest Quarter of Section 5 and the Southeast Quarter of Section 6, all in Township 51, Range 33, Kansas City, Platte County, Missouri, being described as follows: Beginning at the intersection of the east line of the Southeast Quarter of said Section 6 and the northerly line of Missouri Route 152, as now established; thence North 88 46'23" West, along said northerly line, 1322.67 feet; thence North 0 24'47" East, along the west line of the East One-Half of said Southeast Quarter, 2327.07 feet to a point on the north line of said Southeast Quarter; thence South 88 54'34" East, along the north line of said Southeast Quarter, 1324.71 feet to the northeast corner of said Southeast Quarter; thence South 0 27'51" West, along the west line of the Southwest Quarter of said Section 5, 990.00 feet; thence South 88 12'46" East, 2088.44 feet to a point on the westerly line of the Kansas City, Clay County, and St. Joseph Railroad; thence South 37 04'30" East, along said westerly line, 689.06 feet to a point on the westerly line of Green Hills Road, as now established; thence South 6 44'57" West, along said westerly line, 119.30 feet; thence North 88 08'54" West, 281.41 feet; thence South 0 24'33" West, 152.60 feet; thence South 88 08'54" East, 269.97 feet to a point on the west line of said Green Hills Road; thence South 0 24'33" West, along said west line, 36.98 feet to a point on the northerly line of N.W. 88th Street, as now established; thence North 88 08'12" West, along said northerly line, 369.97 feet; thence North 0 24'33" East, along said northerly line, 20.01 feet; thence North 88 08'12" West, along said northerly line, 121.98 feet; thence westerly, along said northerly line, on a curve to the left, tangent to the last described course, having a radius of 1450.00 feet, an arc distance of 148.55 feet; thence South 88 59'36" West, along said northerly line, 51.94 feet; thence westerly, along said northerly line, along a curve to the right, tangent to the last described course, having a radius of 1350.00 feet, an arc distance of 138.31 feet; thence North 88 08'12" West, along said northerly line, 120.28 feet; thence South 0 24'33" West, along said northerly line, 20.01 feet; thence North 88 08'12" West, along said northerly line and its westerly prolongation, 1533.41 feet to a point on the west line of said Southwest Quarter; thence South 0 27'51" West, along said west line, 478.35 feet to the point of beginning.

 

is hereby rezoned from Districts GP-5 (Medium Density Residential Uses) and GP-7 (Agricultural and Low Density Residential Uses) to District GP-5 (Medium Density Residential Uses), all as shown outlined on a map marked Section 80-11A0010, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended,

commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineer's Office for approval when the first plat is submitted and that the

developer make any necessary improvements as required by the City Engineer's

Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to the commencement of any construction

activities.

 

4. That the developer dedicate additional right of way for Tiffany Springs Road as required by the Department of Public Works so as to provide 40 feet of right of way

as measured from the centerline of Tiffany Springs Road.

 

5. That the developer improve the south half of Tiffany Springs Road to secondary arterial street standards including construction of sidewalks.

 

6. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

7. That the developer grant a Noise and Aviation Easement to the City.

 

8. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the first final plat.

 

9. That the developer install hard surface roads and fire protection prior to construction beyond foundations.

 

10. That the developer provide for fire protection as required by the Fire Department.

 

11. That the developer extend water mains as required by the Water Services Department.

 

12. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

13. That the developer secure the approval of the Missouri Highway and Transportation Department for any work in State right of way.

 

14. That the developer contribute $40,892.06 in lieu of parkland dedication for 272 single family lots in satisfaction of Section 66-128 of the Subdivision Regulations.

 

15. That the developer submit a street tree planting plan with the final plat with spacing, species and size of street trees to be approved by the City Forester.

 

16. That the developer enter into a Fair Disclosure Agreement to provide disclosure at the time of any real estate transaction.

 

17. That the developer prohibit any structure that exceeds the height as defined in the KCI Airport Zoning Map.

 

18. That the developer petition for the vacation of N. Beaman Avenue, south of N.W. 88th Terrace, as required by the Department of Public Works and that the developer

replat and process said property as determined necessary by the City Engineer's

Office in accordance with Chapter 66, Code of Ordinances, commonly known as the

Subdivision Regulations.

 

19. That the developer replat existing Lots 1 and 2, Autumn Ridge First Plat, as required by the Department of Public Works so as to provide the private open space as shown

on the development plan and that the developer submit covenants, conditions and

restrictions for maintenance of the private open space to the Law Department for

approval.

 

20. That the developer submit a final plan for the pool/pavilion area to the City Plan Commission for approval including plans for landscaping and screening.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 961597, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
