ORDINANCE NO. 060114

 

Rezoning an area of approximately 66 acres generally bounded by 26th Street on the north, 31st Street on the south, Mercier Street on the west and Summit Street on the east from Districts R-4 and C-2 to Districts R-1b, R-2b and R-4.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0660, rezoning an area of approximately 66 acres generally bounded by 26th Street on the north, 31st Street on the south, Mercier Street on the west and Summit Street on the east from Districts R-4 (Low Apartments) and C-2 (Local Retail Business) to Districts R-1b (One-Family Dwellings), R-2b (Two-Family Dwellings) and R-4 (Low Apartments), said section to read as follows:

 

Section 80-11A0660. That an area legally described as:

 

Lots 1-19 inclusive, Block 10, Gates Addition, and Lots 1-4 inclusive, Block 4, Lincoln Park and the east half of the vacated alley lying west and adjacent said lots, and all vacated 26th Street Terrace lying east of the projected centerline of said vacated alley; and

 

Lots 1-40 inclusive, Block 9, Gates Addition, except that portion in right of way, and Lots 1-8 inclusive, Block 3, Lincoln Park, and the vacated alley within said blocks; and

 

Lots 1-13 inclusive and the north 12.5 feet of Lot 14 and Lots 17-40 inclusive, Block 8, Gates Addition, and Lots 1-4 inclusive, Block 2, Lincoln Park, and Lots A-E inclusive, Lincoln Park, and

 

Lots 5-8 inclusive, Block 1, Lincoln Park, and Lots 21-40 inclusive, Block 7, Gates Addition, and

 

Lots 1-11 inclusive, Block 4, Winter Park Addition, and

 

Lots 1-48 inclusive, Block 2, Conover & Fosters Addition, and

 

Lots 1-22 inclusive and Lots 25-48 inclusive, Block 3, Conover & Fosters Addition, except that portion in right of way, and

 

Lots 1-16 inclusive and Lots 31-48 inclusive, Block 5, Lincoln Park Addition, except that portion in right of way, and

 

Lots 1-6 inclusive and Lots 45-52 inclusive, Block 5, Conover & Fosters Addition, except that portion in right of way, and

 

Lots 18-26 inclusive, Block 8, Conover & Fosters Addition, except that portion in right of way, and

 

Lots 6-41 inclusive, Block 8, Lincoln Park, except that portion in right of way, and

 

Lots 1-22 inclusive and Lots 27-52 inclusive, except that portion in right of way, Block 7, Lincoln Park Addition, and Lots 1-8 inclusive, Streichers Subdivision of Lots 23, 24, 25 & 26 Block 7, Lincoln Park, and

 

Lots 5-44 inclusive, Block 12, Winter Park, and

 

Lots 4-41 inclusive, Block 2, Continuation of Conover and Fosters Addition, and

 

Lots 1-11 inclusive and Lots 23-41 inclusive, Block 1, Continuation of Conover and Fosters Addition, and

 

Lots 1-22, Boschenriether Place, and

 

Lots 9-40 inclusive, Block 1, Rotterdam, and

 

Lots 1-19 inclusive, Block 13, Winter Park, and

 

Lots 6-19 inclusive and Lots 30-48 inclusive, Block 3, Continuation of Conover and Fosters Addition and all Lots 1-5 inclusive, Block 3, Continuation of Conover and Fosters Addition, said Lots 1-5 also known as Tracts A and B, Certificate of Survey S-5, PG-51, and

 

Lots 1-19 inclusive, Block 4, Continuation of Conover and Fosters Addition, except that portion in right of way, and the west half of vacated Belleview Avenue lying east and adjacent Lots 11-19 inclusive, Block 4, Continuation of Conover and Fosters Addition, and Lots 30-48 inclusive, Block 4, Continuation of Conover and Fosters Addition

 

is hereby rezoned from Districts R-4 (Low Apartments) and C-2 (Local Retail Business) to District R-1b (One-Family Dwellings), and that an area legally described as

 

The south 12.5 feet of Lot 14, and all Lots 15 and 16, Block 8, Gates Addition, and

 

Lots 12-22 inclusive, Block 1, Continuation of Conover and Fosters Addition, and

 

Lots 4-22 inclusive, Van Dyke Place

 

is hereby rezoned from Districts R-4 (Low Apartments) to District R-2b (Two-Family Dwellings), and that an area legally described as

 

Lots 20-24 inclusive, Block 13, Winter Park, and Lots 20-29 inclusive, Block 3, Continuation of Conover and Fosters Addition

 

is hereby rezoned from District C-2 (Local Retail Business) to District R-4 (Low Apartments).

 

All of the above legal descriptions are in Sections 7 and 18, Township 49 North, Range 33 West, Kansas City, Jackson County, Missouri, and all are as shown outlined on a map marked Section 80-11A0660, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
