ORDINANCE NO. 011001

 

Approving the First Amendment to the Development Plan submitted by the Westside Industrial Redevelopment Corporation on a tract of land of approximately 22 acres generally located on the west side of Southwest Boulevard between 25th and 27th Streets; and authorizing execution of a First Amendment to Redevelopment Contract with the Westside Industrial Redevelopment Corporation.

 

WHEREAS, Westside Industrial Redevelopment Corporation, an urban redevelopment corporation organized under and pursuant to the Urban Redevelopment Corporation Act of 1945, as amended, did on November 9, 1995, file with the City Clerk an application for approval of a Development Plan which was approved by the City Council by Ordinance No. 960504, passed June 6, 1996; and

 

WHEREAS, Westside Industrial Redevelopment Corporation did file with the City Clerk an application for a First Amendment to the Development Plan on November 17, 2000, revised on February 23, 2001; and

 

WHEREAS, the City Plan Commission did cause to be published in The Pulse, a newspaper doing the City's printing, on December 18, 2000, that date being not less than ten days prior to the date set for the hearing, notice of the public hearing on the First Amendment to the Development Plan; and

 

WHEREAS, said City Plan Commission did hold a public hearing on the First Amendment to the Development Plan on January 16, 2001; and

 

WHEREAS, at the public hearing conducted by the City Plan Commission, all interested parties were given an opportunity to be heard at said public hearing; and

 

WHEREAS, the City Plan Commission has made a study and investigation of the proposed First Amendment to the Development Plan and did, on January 16, 2001, recommend approval of the First Amendment to the Development Plan and did submit a report of the same, a copy of which is attached hereto and incorporated herein by reference as Exhibit "A"; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the application of the Westside Industrial Redevelopment Corporation for approval of a First Amendment to the Development Plan, including all exhibits incorporated therein, is hereby incorporated by reference and approved as a First Amendment to the Development Plan as originally approved by Ordinance No. 960504, passed June 6, 1996. A copy of the application and exhibits are on file in the office of the City Clerk under Document No. 011001, which is attached hereto and incorporated herein by reference.

 


Section 2. That the Council hereby finds and declares that good cause has been shown for the approval of the First Amendment to the Development Plan of the Westside Industrial Redevelopment Corporation and that the findings and declarations made by the Council in Sections 2 and 5 of Ordinance No. 960504 with respect to the Development Plan have not been affected by the amendments thereto and equally apply to said Development Plan, as amended.

 

Section 3. That the Council hereby finds and determines that the public convenience and necessity will be served by the Development Plan, as amended.

 

Section 4. That the Director of Finance be, and he is hereby, authorized and directed on behalf of the City to enter into a First Amendment to Redevelopment Contract with the Westside Industrial Redevelopment Corporation, a copy of which, in substantial form, is attached hereto as Exhibit B and is hereby approved.
