ORDINANCE NO. 030206
Repealing and reenacting
Section A of Ordinance Nos. 021503 and 021504 to correct the legal
descriptions.
WHEREAS on
January 30, 2003, the City Council did pass Ordinance No. 021503, to amend
Chapter 80, Code of Ordinances, commonly known as the Zoning Ordinance by
adding a new section to be known as Section 80-11A0453 rezoning an area of
approximately 130 acres generally bounded by Missouri Route 152 on the north,
N.W. Barry Road on the south, the prolongation of a line approximately 125 east
of N. Winan Avenue on the east, and the prolongation of a line approximately
120 feet west of N. Winfield Avenue on the west from District GP-6 (Low-Density
Residential Uses) and District GP-7 (Agricultural and Low-Density Residential
Uses) to District GP-6 (Low-Density Residential Uses); and
WHEREAS on
January 30, 2003, the City Council also did pass Ordinance No. 021504, amending
the General Development and Land Use Plan, Kansas City International Airport,
as amended, by changing the land use designation from agricultural and
recreational and low density residential uses to low density residential uses
for the approximately 130 acre tract described above; and
WHEREAS the
Council finds and declares that before taking any of the actions described
hereinabove, all public notices and hearings required by the Zoning Ordinance
have been given and had; and
WHEREAS the area
shown outlined and described on the map marked Section 80-11A0453, which was
adopted as a part of an amendment to the zoning maps constituting a part of
said chapter and as an amendment to Section 80-11 thereof did contain a
scribners error not properly identifying the area to be rezoned; NOW,
THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
Section A of Ordinance No. 021503 is hereby repealed and the following Section
A is hereby enacted:
Section A. That Chapter 80, Code
of Ordinances of the City of Kansas City, Missouri, commonly known as the
Zoning Ordinance, is hereby amended by enacting a new section to be known as
Section 80-11A0453, rezoning an area of approximately 130 acres generally
bounded by Missouri Route 152 on the north, N.W. Barry Road on the south, the
prolongation of a line approximately 125 feet east of N. Winan Avenue on the
east, and the prolongation of a line approximately 120 feet west of N. Winfield
Avenue on the west, from Districts GP-6 (Low Density Residential Uses) and GP-7
( Agricultural and Low Density Residential Uses) to District GP-6 (Low Density
Residential Uses), said section to read as follows:

80-11A0453. That an area legally described as:
All that
part of the Northeast Quarter of Section 10, Township 51, Range 34, Kansas
City, Platte County, Missouri, being more particularly described as follows:
Commencing at the northwest corner of said Northeast Quarter; thence south
along the west line of said Northeast Quarter to the south right of way line of
Missouri Highway No. 152, as now established; thence easterly along said south
right of way line to the northeast corner of Wildwood West - Second Plat,
according to the recorded plat thereof; thence southerly, along the east lines
of Wildwood West - Second Plat and Wildwood West - First Plat, according to the
recorded plats thereof, to the north right of way line of N.W. Barry Road, as
now established; thence westerly along said north right of way line to the east
line of a tract of land conveyed by Document No. 14598 to Daisy Bell and James
Francis Bell, as shown in the deed records of Platte County, Missouri; thence
northerly along the east line of said conveyed tract to the north line thereof;
thence westerly along the north line of said conveyed tract to the west line
thereof; thence southerly along the west line of said conveyed tract to the
north right of way line of N.W. Barry Road, as now established; thence west
along said north right of way line to the west line of said Northeast Quarter;
thence north along the west line of said Northeast Quarter to the point of
beginning.

hereby rezoned from Districts GP-6 (Low Density Residential Uses) and GP-7
(Agricultural and Low Density Residential Uses) to District GP-6 (Low Density
Residential Uses), all as shown outlined on a map marked Section 80-11A0395,
which is attached hereto and made a part hereof, and which is hereby adopted as
a part of an amendment to the zoning maps constituting a part of said chapter
and as an amendment to Section 80-11 thereof.
Section 2. That
Section A of Ordinance No. 021504 is hereby repealed and the following Section
A is hereby enacted:
Section A. That the General
Development and Land Use Plan, Kansas City International Airport, as amended,
is hereby amended by changing the land use designation from agricultural and
recreational and low density residential uses to low density residential uses
for an approximately 130 acre tract of land generally bounded by Missouri
Highway 152 on the north, N.W. Barry Road on the south, the prolongation of a
line approximately 125 feet east of N. Winan Avenue on the east, and the
prolongation of a line approximately 120 feet west of N. Winfield Avenue on the
west, and more specifically described as follows:
All that

part hereof, and which is hereby adopted as a part of an amendment to the
aforesaid plan and as an amendment to Section 80-206.
