RESOLUTION NO. 060728
Approving
an amendment to the Briarcliff-Antioch-Davidson Area Plan by modifying the Land
Use Plan and Map for an area of approximately 33 acres generally located at the
northeast corner of N.E. Vivion Road and N. Oak Trafficway, by changing the
recommended land use from public/semi-public to retail/commercial. (241-S-4)
WHEREAS, by
Committee Substitute for Resolution No. 49550, adopted September 28, 1978, the
City adopted the Briarcliff-Antioch-Davidson Area Plan as a guide for
development and redevelopment of that area generally bounded by Englewood Road
on the north, Chouteau Trafficway on the east, North Kansas City city limit
line on the south and the Kansas City city limit line on the west; and
WHEREAS, after
further review by the City Development Department it has been deemed
appropriate to amend the Briarcliff-Antioch-Davidson Area Plan as it affects
that area of approximately 33 acres located at the northeast corner of N.E.
Vivion Road and N. Oak Trafficway, by modifying the recommended land use for
such area from public/semi-public to retail/commercial; and
WHEREAS, public
notice of a hearing before the City Plan Commission was published on May 1,
2006; and
WHEREAS, the
City Plan Commission considered such amendment to the Proposed Land Use Plan and
Map on June 6, 2006; and
WHEREAS, after
all interested persons were given an opportunity to present testimony, the City
Plan Commission did on June 6, 2006, recommend approval of the proposed
amendment to the Briarcliff-Antioch-Davidson Area Plan; NOW, THEREFORE,
BE IT RESOLVED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the amendment to the Briarcliff-Antioch-Davidson Area Plan is hereby approved
as to the Proposed Land Use Plan and Map for that area of approximately 33 acres generally located at the northeast corner of N.E. Vivion Road and N. Oak Trafficway,
by modifying the recommended land use for such area from public/semi-public to retail/commercial.
A copy of the amended Land Use Plan and Map for the Briarcliff-Antioch-Davidson
Area Plan is attached hereto as Exhibit A and made a part hereof.
Section B. That
the amendment to the Briarcliff-Antioch-Davidson Area Plan is consistent and
complies with the FOCUS Kansas City Plan, adopted on October 30, 1997, by
Committee Substitute for Resolution No. 971268, and is adopted as a supplement
to the FOCUS Kansas City Plan.
Section C. That
the Council finds and declares that before taking any action on the proposed
amendment hereinabove, all public notices and hearings required by law have
been given and had.
