Approving the preliminary plat of Rosemont on
approximately a 51.13 acre tract of land generally located at the northeast
corner of N.E. Antioch Road and N.E. 80th Street. (SD 0860)
BE IT ORDAINED BY THE COUNCIL OF
KANSAS CITY:
Section A. That the preliminary
plat of Rosemont on approximately a 51.13 acre tract of land generally located
at the northeast corner of N.E. Antioch Road and N.E. 80th Street, and more
specifically described as follows:
A tract of land in the
Southeast Quarter of Section 7 and the Southwest Quarter of Section 8, all in
Township 51, Range 32, Kansas City, Clay County, Missouri, being bounded and
described as follows: Commencing at the southeast corner of said Southeast
Quarter; thence North 014'47" East along the east line of said Southeast
Quarter, 30.00 feet to the north right of way line of N.E. 80th Street, as now
established, said point being the true point of beginning of the tract to be
herein described; thence continuing North 014'47" East along said east
line, said line being also the east line of Bethel Acres, a subdivision of land
in the City of Kansas City, Clay County, Missouri, 625.88 feet to the northeast
corner of said Bethel Acres; thence North 8939'39" West, along the north
line of said Bethel Acres, 1291.76 feet to a point on the east right of way
line of N. Antioch Road, as now established; thence North 026'51" East,
along said east line, 603.95 feet; thence South 8910'59" East, parallel

32, in Kansas City, Clay County, Missouri, described as follows: Commencing at
the northeast corner of said Half Quarter Section; thence South 251'06"
East, along the east line of said Half Quarter Section, 1224.29 feet to its
intersection with the southwesterly line of a tract of land conveyed to the
State of Missouri for highway purposes by Document No. D-6867, recorded in Book
1171 at page 249, to the point of beginning of the tract to be herein
described; thence continuing South 251'06" East, along said east line,
130.75 feet; thence South 8745'19" West, parallel with the north line of
said Half Quarter Section, 1289.81 feet to a point on the east line of Antioch
Road (Missouri State Route J-1) as now established; thence North 239'00"

southwesterly line of the tract conveyed to the State of Missouri for highway

said southwesterly line, 1128.85 feet to an angle point therein; thence South

beginning.
is hereby approved,
subject to the following conditions:
1. That
the developer cause the area to be platted and processed in accordance with
Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as
amended, commonly known as the Subdivision Regulations.
2. That
the developer submit a storm drainage study to the City Engineers Office for
approval and that the developer make any necessary improvements as required by
the City Engineer's Office.
3. That
the developer submit plans for grading and siltation and erosion control to the
City Engineers Office for approval prior to beginning any construction
activities.
4. That
the developer secure a land disturbance permit from the Missouri Department of
Natural Resources.
5. That
the developer extend water mains as required by the Water Services Department.
6. That
the developer construct hard surface all-weather roads and provide for fire
protection as required by the Fire Department prior to construction beyond
foundations.
7. That
the developer submit a street tree planting plan as part of the final plat and
secure the approval of the City Forester for street trees planted on right of
way in front of residential lots, with a copy to be submitted to the Department
of City Development. The plan shall include size, type, species and placement
of trees.
8. That
the developer dedicate additional right of way for N.E. Antioch Road as
required by the Department of Public Works so as to provide 30 feet of right of
way as measured from the centerline of N.E. Antioch Road.
9. That
the developer dedicate additional right of way for N.E. 80th Street as required
by the Department of Public Works so as to provide 30 feet of right of way as
measured from the centerline of N.E. 80th Street.
10. That
the developer improve the eastern half of N.E. Antioch Road to collector street
standards as required by the Department of Public Works.
11. That
the developer improve the northern half of N.E. 80th Street to collector street
standards as required by the Department of Public Works.
12. That
the developer secure the approval of the Missouri Department of Transportation
prior to working in any State right of way.
13. That
the developer obtain a floodplain certificate from the Department of Codes Administration
prior to beginning any construction activities within the floodplain.
14. That
the developer show the limits of the floodplain on the final plat as required
by the Department of Public Works.
15. That
the developer contribute $51,182.47 in lieu of parkland dedication for 128
single-family lots (128 x 3.7 x 0.006 x $18,011.85 = $51,182.47) in
satisfaction of Section 66-128 of the Subdivision Regulations.
16. That
the developer extend sanitary sewers as required by the Department of Public Works.
17. That
the developer receive the approval of the Board of Zoning Adjustment for any
signage.
18. That
the developer submit a street name sign plan for the entire preliminary plat
area to the Street Naming Committee for approval prior to submittal of the
first final plat.
A copy of the preliminary plat is on file in the
office of the City Clerk under Document No. 990723, which is attached hereto
and made a part hereof.
Section B. That the Council finds
and declares that before taking any action on the proposed preliminary plat
hereinabove, all public notices and hearings required by the Subdivision
Regulations have been given and had.
