ORDINANCE NO. 050355

 

An ordinance to approve the Preliminary Plat, Cannon & Wesley Estates on an 89.19 acre tract of land generally located on the east side of Interurban Road about 1850 feet north of NW 128th Street (SD 1159)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Cannon & Wesley Estates on an 89.19 acre tract of land generally located on the east side of Interurban Road about 1850 feet north of N.W. 128th Street, and more specifically described as follows:

 

All that part of the West one-half of the Northwest Quarter and West one-half of the Southwest Quarter of Section 12, Township 52 North, Range 34 West of the 5th P.M., Platte County, Missouri lying North and East of Interurban Road, as now established, and being more particularly described as follows:

 

Beginning at the Northwest corner of the Northwest Quarter of said Section 12; thence South 894616 East, along the North line of said Northwest Quarter, a distance of 1333.50 feet to the Northeast corner West one-half of said Northwest Quarter; thence South 003625 West, along the East line of said West one-half, a distance of 2642.20 feet to the Southeast corner of the West one-half of said Northwest Quarter; thence South 002834 West, along the East line of the West one-half of the Southwest Quarter of said Section 12, a distance of 1166.43 feet to the Northeasterly right of way for Interurban Road, as now exists; thence North 362212 West, along said Northeasterly right of way, a distance of 2215.10 feet to the intersection of said Northeasterly right of way with the West line of the Northwest Quarter of said Section 12; thence North 003002 East, along said West line, a distance of 2030.24 feet to the Point of Beginning and containing 3,885,016 square feet or 89.19 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer receive the approval of the Board of Zoning Adjustment for any necessary variances.

 

2. That the developer shall cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

3. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri Licensed Civil Engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to the City Engineer's Office with the final plat application, and that the developer construct any improvements as required by the City Engineer's Office.

 

4. That the developer dedicate additional right of way for a secondary arterial with a bike path as required by the Department of Public Works so as to provide a minimum of 46 feet of right of way as measured from the centerline of Interurban Road.

 

5. That the developer extend sanitary sewers to ensure individual service is provided to all proposed lots and determine adequacy as required by the Department of Public Works.

 

6. That the developer shall subordinate to the City all private interest in the area of any right-of-way dedication as required by the Department of Public Works and that the developer shall be responsible for all costs associated with subordination activities.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance, and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
