ORDINANCE NO. 980698

 

Authorizing a Cooperative Agreement between Kansas City, Missouri and Jackson County, Missouri required by the construction of the Jackson-Cass Transmission Main project; and directing the City Clerk to record same.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Mayor of Kansas City is hereby authorized to execute, on behalf of Kansas City, a Cooperative Agreement with Jackson County, Missouri permitting installation, operation and maintenance of a water transmission main through a portion of the sports complex property to accommodate construction of the Jackson-Cass Transmission Water Main Phase I. A copy of said Agreement is on file in the office of the Director of Water Services.

 

Section 2. That the Director of Water Services is authorized to administer the Agreement and expend up to the sum of $40,014.50 from funds previously appropriated to the following account to satisfy the terms of the Agreement, which amount represents the cost of a permanent easement, tree replacement and underground storage tank removal and remediation.

Section 3. That upon the effective date of said Agreement, the City Clerk is directed to cause a copy of this ordinance and of the Agreement to be recorded in the Office of the Recorder of Deeds for Jackson County, Missouri, and with the Secretary of State of the State of Missouri, in accordance with R.S.Mo. Sec. 70.300 (1994).

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
