Approving the preliminary plat of Carter-Waters on a 4.14 acre tract of land generally located on the south side of Dowden Place about 600 feet west of N. Jackson Avenue. (SD 1299)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Carter-Waters on a 4.14 acre tract of land generally located on the south side of Dowden Place about 600 feet west of N. Jackson Avenue, and more specifically described as follows:

 

A tract of land located in the Southeast 1/4 of Section 22, Township 50, Range 33, in Kansas City, Jackson County, Missouri, more particularly described as follows: Beginning at the northeast corner of Block 2, Saint Paul Addition; thence South 0000'17" West on the east line of said Block 2 a distance of 313.35 feet; thence North 8959'43" West, a distance of 40.00 feet; thence South 0000'17" West, a distance of 5.00 feet; thence North 8959'43" West, a distance of 265.00 feet to the centerline of Myrtle Avenue as vacated by Kansas City, Missouri, under Ordinance No. 061044, introduced 9/28/06; thence South 0000'17" West on said centerline of Myrtle Avenue a distance of 0.97 feet; thence North 8951'28" West, a distance of 366.92 feet to the southeasterly right of way line of a levee as condemned by Kansas City, Missouri, under Ordinance No. 11221, as amended by Ordinance No. 11473; thence North 3426'38" East on said levee right of way line a distance of 51.90; thence North 3552'33" East on said levee right of way line a distance of 364.68 feet; thence North 8957'31" East, a distance of 123.88 feet to the said centerline of Myrtle Avenue; thence South 0000'17" West on said centerline of Myrtle Avenue, a distance of 19.98 feet to the south right of way line of Dowden Place, as now established; thence South 8959'43" East on said right of way line a distance of 305.00 feet to the point of beginning. Contains 180,324 square feet or 4.14 acres, more or less. Subject to easements, restrictions, and reservations now of record.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations.

 

2. That the developer submit a detailed micro storm drainage study, consisting at a minimum of a letter from a Missouri licensed civil engineer stating that the proposed improvements will not alter or increase historical runoff conditions for the site, to Development Services prior to review and issuance of any building permits, and that the developer construct any improvements as required by Development Services.

 

3. That a 5 foot variance to the minimum required right-of-way width of 25 feet for the south half of Dowden Place, a local residential street, so as to permit 20 feet of right-of-way as shown on the development plan, is hereby granted.

 

4. That the developer submit plans for grading, siltation, and erosion control to Development Services for approval and permitting prior to beginning any construction activities.

 

5. That the developer obtain a floodplain certificate from Development Services prior to beginning any construction activities within the floodplain.

 

6. That the final plat show the limits of the 100-year floodplain and the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year floodplain area.

 

A copy of the preliminary plat is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
