ORDINANCE NO. 140648

 

Rezoning an area of approximately 344 acres generally bounded by the Blue River Glade on the north, Hillcrest Road on the east, Hickman Mills Drive and Blue River Road on the west, and on the north and south sides of E. 87th Street from Districts R-80, R-1.5, R-7.5, M1-5, and B3-2 to District UR, and approving a development plan for a mixed-use development for research, retail, restaurant, entertainment, recreation, community, cultural, educational, multi-family residential, office, and other compatible commercial uses. (14467-UR, known as Oxford on the Blue)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0969, rezoning an area of approximately 344 acres from Districts R-80 (Residential 80), R-1.5 (Residential 1.5), R-7.5 (Residential 7.5), M1-5 (Manufacturing 1, dash 5), B3-2 (Community Business, dash 2) to District (Urban Redevelopment) and approving a development plan for a mixed-use development for research, retail, restaurant, entertainment, recreation, community, cultural, educational, multi-family residential, office, and other compatible commercial uses, said section to read as follows:

 

Section 88-20A0969. That an area legally described as:

 

SITE A: All of Lots 1, 2, 3 and Tract "A" of Consolidated Service Center; part of Lots 8 and 9, Hoelzels Blue River Heights; all of Lot 1, 2, 6 and part of Lot 3, Green Valley Acres; all of Jackson Hills; all of Lots 1 through 4, both inclusive, Lugeanbeal's Addition; all of Lots 5 and 6, Corrected Plat of Lugeanbeal's Addition, Lots 5 and 6, all subdivisions in Kansas City, Jackson County, Missouri; and all that part of Sections 14, 22 and 23, all in Township 48 North, Range 33 West of the Fifth Principal Meridian, and part of 87th Street as established by Document No. A-427838, in Book 2940, at page 410, in Kansas City, Jackson County, Missouri, more particularly described as follows: Commencing at the southwest corner of the Northwest 1/4 of said Section 23, thence North 2 degrees 20 minutes 09 seconds East, along the west line of the Northwest 1/4 of said Section 23, a distance of 1315.47 feet to the northeast corner of the south half of the Northeast 1/4 of said section 22; thence North 86 degrees 40 minutes 19 seconds West, a distance of 940.00 feet to the most easterly corner of the tract of land described in Tract 3 in Document No. K-89537, in Book 198 at page 156, said point being the point of beginning of the tract to be herein described: thence North 25 degrees 52 minutes 00 seconds West along the easterly line of said tract, a distance of 129.26 feet, to the most northerly corner thereof, said point being on the southeasterly right-of-way line of Blue River Road, as now established; thence this and the following courses along said southeasterly right-of-way line, along a curve to the left having an initial tangent bearing of North 64 degrees 08 minutes 00 seconds East, a radius of 11510.49 feet, a central angle of 0 degrees 08 minutes 07 seconds and an arc length of 27.18 feet; thence departing said north right-of-way line, North 53 degrees 20 minutes 07 seconds East along said southeasterly line, a distance of 118.25 feet, to a point on the south line of the North 1/2 of the Northeast 1/4 of said Section 22, said point also being the point of beginning, containing 13,753,144 square feet or 315.73 acres, more or less.

 

All that part of Section  23, Township 48 North, Range 33 West of the Fifth Principal Meridian, in Kansas City, Jackson County, Missouri, more particularly described as follows:  Beginning at the intersection of the north right-of-way line of E. 87th Street, as now established and the west right-of-way line of Hillcrest Road, as now established; thence north along said west right-of-way line, 200 feet; thence west 200 feet; thence south 200 feet to a point on said north right-of-way line; thence east, along said north right-of-way line, 200 feet to the point of beginning. Containing 40,000 square feet or 0.91 acres more or less.

 

SITE B: A tract of land in the Northeast Quarter of Section 22, Township 48 North, Range 33 West of the 5th Principal Meridian in Kansas City, Jackson County, Missouri being bound and described as follows:

 

Beginning at the Southeast corner of said Northeast Quarter; thence North 86 degrees 48 minutes 00 seconds West along the South line of said Northeast Quarter, a distance of 1157.93 feet to a point on the West line of the abandoned Burlington Northern Railroad right of way, said line also being the East right of way line of U.S. 71 Highway, as now established; thence North 19 degrees 11 minutes 47 seconds West, along said right of way lines, a distance of 728.89 feet; thence Northwesterly, continuing along said right of way lines, along a curve to the left, being tangent to the last described course, having a radius of 1382.69 feet and a central angle of 15 degrees 22 minutes 42 seconds, an arc distance of 371.12 feet to point on the Easterly right of way line of Blue River Road, as now established; thence North 39 degrees 40 minutes 53 seconds East, along said right of way line, 64.47 feet; thence Northeasterly, along a curve to the right, having an initial tangent bearing of North 39 degrees 43 minutes 04 seconds East with a radius of 778.65 feet, a central angle of 25 degrees 25 minutes 10 seconds and an arc distance of 345.45 feet; thence North 65 degrees 25 minutes 52 seconds East, 13.89 feet to a point on the Southwesterly right of way line of relocated 87th Street, as established in a deed filed for record as Document No. K838048 in Book K1824 at page 2321; thence Southeasterly, along said Southwesterly right of way line on a curve to the left, having an initial tangent bearing of South 57 degrees 24 minutes 48 seconds East, a radius of 791.20 feet and a central angle of 25 degrees 56 minutes 36 seconds, an arc distance of 358.25 feet; thence South 57 degrees 24 minutes 48 seconds East, continuing along said Southwesterly right of way line, along the Southeasterly prolongation, a distance of 1001.56 feet to a point on the Southerly line of 87th Street, as established by conveyance of right of way recorded as Document No. A427864 in Book B2944 at page 190; thence Easterly, along said Southerly right of way line, on a curve to the right, having an initial tangent bearing of South 81 degrees 08 minutes 11 seconds East, a radius of 438.34 feet and a central angle of 23 degrees 12 minutes 59 seconds, an arc length of 177.62 feet to a point on the East line of said Northeast Quarter; thence South 2 degrees 20 minutes 12 seconds West, along said East line a distance of 493.02 feet to the point of beginning. Containing 1,187,627 square feet or 27.26 acres, more or less.

 

is hereby rezoned from Districts R-80 (Residential 80), R-1.5 (Residential 1.5), R-7.5 (Residential 7.5), M1-5 (Manufacturing 1, dash 5), B3-2 (Community Business, dash 2) to District UR (Urban Redevelopment),

 

Section B. That a development plan for the above-described area is approved for a mixed-use development for research, retail, restaurant, entertainment, recreation, community, cultural, educational, multi-family residential, office, and other compatible commercial uses, subject to the following conditions:

 

(1)               That prior to submittal of any final plats, site plans, or construction documents, a revised development plan/preliminary plat be submitted for review and approval per Section 88-545-03.

 

(2)               That for each project or phase of the development plan, the developer submit a site plan to the Director of the Department of City Development for approval prior to issuance of a building permit. The site plans shall include:

 

a.                   development plan information;

b.                  property uses;

c.                   setback distances;

d.                  lighting (per 88-430 of the Zoning & Development Code);

e.                   landscaping (per 88-425 of the Zoning & Development Code);

f.                   signage (per 88-445 of the Zoning & Development Code); and

g.                  architectural characteristics, including materials.

 

(3)               That prior to submittal of any final plats, site plans, or construction documents a revised traffic study be submitted for review and approved.

 

(4)               That the developer revise the UR preliminary development plan prior to submittal of any final plats, site plans, or construction documents (submit one folded, stapled, and collated copy and digital copy via e-mail) and portray conveyance of ownership and responsibility for Stream Buffers zones (per 88-415-09-A or B) on the plan.

 

(5)               That the developer cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended.

 

(6)               That the developer submit a macro "overall" storm drainage study for the entire development to the Land Development Division for review and acceptance at the time the first plat is submitted, with a micro "detailed" storm drainage study, including a BMP level of service analysis, to be submitted for each phase at the time of final platting, and that the developer secure permits to construct any improvements as required by the Land Development Division prior to recording the plat.

 

(7)               That the developer dedicate additional right of way for Hillcrest Road as required by the adopted Major Street Plan so as to provide a minimum of 50 feet of right of way as measured from the centerline and ensure right of way dedication is adequate for any proposed road improvements adjacent to this project, as required by the Public Works Department.

 

(8)               That the developer vacate existing right of way within the development as required by the Land Development Division and that the vacation occur with the final plat application.

 

(9)               That the developer design and construct all interior public streets to City standards, as required by the Land Development Division, including curb and gutter, storm sewers, streetlights, and sidewalks, with exceptions to the standards noted on the typical details included with the approved development plan.

 

(10)           That the developer pay impact fees as required by Chapter 39 of the City's Code of Ordinances as required by the Land Development Division.

 

(11)           That the developer obtain the executed and recorded grading consents and all City approved grading, temporary construction, drainage/sewer, or any other necessary easements from the abutting property owner(s) that may be required prior to submitting any public improvements crossing properties not controlled by the developer and include said document(s) within the public improvement applications submitted for permitting.

 

(12)           That the developer subordinate to the City all private interest in the area of any right-of-way dedication, in accordance with Chapter 88 and as required by the Land Development Division and that the owner/developer shall be responsible for all costs associated with subordination activities now and in the future.

 

(13)           That the developer integrate into the existing streetlight system any relocated existing streetlights within the street right-of-way impacted by the new drive or approach entrances as required by the Land Development Division, and that the relocated lights comply with all adopted lighting standards.

 

(14)           That the owner/developer submit plans for grading, siltation, and erosion control to the Land Development Division for review, acceptance, and permitting for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

(15)           That the owner/developer secure a site disturbance permit from the Land Development Division prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more during the life of the construction activity.

 

(16)           That the developer secure permits to extend sanitary and storm water conveyance systems to serve all proposed lots within the development and determine adequacy of receiving systems as required by the Land Development Division, prior to recording the plat or issuance of a building permit whichever occurs first.

 

(17)           That the developer provide acceptable easement and secure permits to relocated sanitary sewers out from under proposed buildings and structures, etc., while continuing to ensure individual service is provided to all proposed lots as required by the Land Development Division prior to recording the plat or issuance of a building permit, whichever occurs first.

 

(18)           That the developer delineate any stream buffer zones by submitting a preliminary buffer plan in accordance with the Section 88-415 requirements.

 

(19)           That the developer submit a final stream buffer plan, prepared in accordance with Section 88-415, for review and acceptance by the Land Development Division, with the final plat application and prior to building permit issuance, whichever occurs first.

 

(20)           That the developer show and label the final stream buffer zones on the subdivision plat within a private open space tract (or stream buffer easement), as required by the Land Development Division.

 

(21)           That the developer show the lowest opening or elevation or Minimum Low Opening (MLO) of any structure on each lot that abuts a 100-year floodplain area on any plat and plan, as required by the Land Development Division.

 

(22)           That the developer grant on City approved forms, BMP and STREAM BUFFER Easements (submit the executed and recorded BMP and STREAM BUFFER Easements) to the City, as required by Chapter 88 and the Land Development Division, prior to issuance of any building permits or bmp permits, whichever occurs first.

 

(23)           That the owner/developer grant on City approved forms, surface drainage easement to the City, as required by Chapter 88 and the Land Development Division, prior to issuance of any temporary certificate of occupancy.

 

(24)           That the developer submit a street name signage plan for the entire development area for approval by the Street Naming Committee prior to submittal of the first final plat as required by the Development Management Division.

 

(25)           That the developer verify vertical and horizontal sight distance for the Hillcrest Road access and make improvements to ensure minimum AASHTO adequate sight distance standards are met.  

 

26)                That the developer extend, relocate, and abandon public and/or private water and sewer mains as required by the Water Services Department.

 

27)                That the developer provide water and sewer main easements as required by the Water Services Department.

 

28)                That the developer provide fire protection as required by the Fire Department.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning and Development Code have been given and had.
