ORDINANCE NO. 160094

 

Declaring it necessary to open, establish and dedicate street right-of-way for 9th Street, Forester Road, and Union Avenue, as well as to re-establish the horizontal and vertical location of portions of 9th Street, Forester Road, Hickory Street, Santa Fe Street, and Union Avenue, in connection with KCMO Project Number 309-089-7271-YXX-5438 – The Bruce Forester Viaduct Replacement over Mulberry Street, Santa Fe Street, and Union Pacific Railroad, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference, all in Kansas City, Jackson County, Missouri; and upon the effective date of this ordinance, the City Clerk is hereby directed to record the ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.

 

WHEREAS, the Council finds that for the public good it is necessary to open, establish and dedicate street right-of-way for 9th Street, Forester Road, and Union Avenue, in connection with the completion of the reconstructed Forester Road Viaduct, in the area between Liberty Street and Beardsley Road, all in Kansas City, Jackson County, Missouri; and

 

WHEREAS, the Council further finds that for the public good it is necessary that the horizontal and vertical location of 9th Street, Forester Road, Hickory Street, Santa Fe Street, and Union Avenue, all in Kansas City, Jackson County, Missouri, be re-established in relation to the newly dedicated street right-of-way; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That finding it necessary to locate, open, and establish the horizontal and vertical location of portions of 9th Street, Forester Road, Hickory Street, Santa Fe Street, and Union Avenue, in the area between Liberty Street and Beardsley Road, all being in Kansas City, Jackson County, Missouri, the Council hereby directs that the City Clerk, upon the effective date of this ordinance, record said ordinance in the office of the Recorder of Deeds for Jackson County, Missouri.

 

Section 2. That said horizontal and vertical locations are of the nature described and specified in, and are in accordance with the plans and specifications prepared and certified by the City Engineer under the supervision of the Director of Public Works and identified as KCMO Project Number 309-089-7271-YXX-5438 – The Bruce Forester Viaduct Replacement over Mulberry St., Santa Fe St., and Union Pacific Railroad, the same being on file in the Office of the Director of Public Works and being incorporated herein by reference.

 

Section 3. That the width of the right-of-way of 9th Street, Forester Road, and Union Avenue, in the area between Liberty Street and Beardsley Road, all being in Kansas City, Jackson County, Missouri, as shown on the plans described in Section 2 of this ordinance, are hereby declared opened, established and dedicated as shown on said plans.

 

Section 4. That the re-establishment of the width and the horizontal and vertical location of the right-of-way of 9th Street, Forester Road, Hickory Street, Santa Fe Street, and Union Avenue, in the area between Liberty Street and Beardsley Road, all being in Kansas City, Jackson County, Missouri, is hereby declared opened and established when this ordinance becomes effective, and are in accordance with the plans and specifications as described in Section 2 of this ordinance; locating and defining the alignment and grade points of said streets on the project centerline stationing, as found on said plans, said centerline being described by state plane coordinates, bearings, distances, and stationing; said grade points being connected by straight grades (tangents) or vertical curves between such grade points, the elevations of which are herein given below in feet (NAD 1983 and NAVD 1988), along with other pertinent alignment data as found on the “General Project Plan and Control Points”, sheet 4 of said plans, to-wit:

 

All grade points are on the new centerline of 9th Street, Forester Road, Hickory Street, Santa Fe Street, and Union Avenue, as herein described, and as found in said plans in the office of the Director of Public Works, and are shown to wit:

Beginning of Horizontal Alignment for 9th Street and Forester Road with the Point of Commencement (POC) being Centerline Station 90+51.706, State Plane Coordinates (SPC) N 1069686.13, E 2759022.89);

 

Thence, S 87 degrees 50 minutes 54 seconds E, a distance of 468.294 feet to a point, said point being labeled on said plans as the Beginning of Project at Station 95+20.00;
