ORDINANCE NO. 190887

 

Rezoning an area of approximately 0.57 acres generally located on the northeast corner of Wyandotte and 13th Streets from District DC-15 to District UR, and approving a development plan to allow for a mixed use development (including office, retail/commercial development and a parking garage). (CD-CPC-2019-00159)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A1217, rezoning an area of approximately 0.57 acres generally located on the northeast corner of Wyandotte and 13th Streets from District DC-15 (Downtown Core) to District UR (Urban Redevelopment), said section to read as follows:

 

Section 88-20A1217. That an area legally described as:

 

Part of Lots 21, 22, 23 and 24, Block 2, Reid's Addition to the City of Kansas, now Kansas City, Jackson County, Missouri, according to the recorded plat thereof, said premises being more particularly described as follows: Beginning in the east line of Wyandotte Street at a point 77 feet north (measured along said east line of Wyandotte Street) of the north line of 13th Street as said streets are now established in said Kansas City, and running thence east along the south boundary line of said Lot 21, and parallel with the north line of 13th Street, a distance of 142.15 feet to the west line of a public alley 16 feet wide; thence north along and with the west line of said alley, 100 feet to the north line of Lot 24 aforesaid; thence west along and with the north line of said Lot 24, and parallel with the north line of 13th Street, a distance of 142.07 feet to the east line of Wyandotte Street; thence south along the east line of Wyandotte Street, 100 feet to the point of beginning and Lots 18, 19 and 20, Block 2, Reid's Addition, a subdivision in Kansas City, Jackson County, Missouri.

 

is hereby rezoned from District DC-15 (Downtown Core) to District UR (Urban Redevelopment), all as shown outlined on a map marked Section 88-20A1217, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.     The developer shall secure approval of a UR Final Development Plan from Development Management Division staff prior to a building permit.

2. The developer shall continue to work with the City Planning and Development staff as it relates to adding additional architectural features along the mostly blank wall on W. 13th Street near the parking garage entrance.

 

3. The two parcels shall be combined prior to the issuance of a certificate of occupancy.

 

4. Uses permitted within this UR Zoning District shall be consistent with those uses associated with the DC Zoning District and the “Downtown Development” design standards of Section 88-338.

 

5. Signage shall follow the standard sign regulations of the City’s Zoning and Development Code unless otherwise approved by a future application for specialized signage requirements.

 

6. The maximum Floor Area Ratio (FAR) shall be set to 15 for this UR development.

 

7. The proposed street planting beds shall follow the recommendations of the Kansas City Downtown Streetscape Master Plan (Ordinance No. 070063).

 

8. Prior to issuance of a final certificate of occupancy, the developer shall submit an affidavit, completed by a landscape architect licensed in the State of Missouri, verifying that all landscaping required of the approved plan has been installed in accordance with the plan and are healthy.

 

9. Prior to issuance of a final certificate of occupancy, a sealed letter by a licensed engineer shall be submitted, stating that photometrics on the site comply with the approved photometric plan.   

 

10. The developer shall subordinate to the City all private interest in the area of any right-of-way dedication, in accordance with Chapter 88 and as required by the Land Development Division, prior to issuance of any construction permits within said right-of-way, and that the owner/developer shall be responsible for all costs associated with subordination activities now and in the future.

 

11. The developer must grant a BMP easement to the City as required by the Land Development Division, prior to recording the plat or issuance of any building permits.

 

12. The developer shall submit a Storm Drainage analysis from a Missouri-licensed civil engineer to the Land Development Division evaluating proposed improvements and impact to drainage conditions. Since this project is within a "Combined Sewer Overflow" (CSO) district, the project shall be designed to retain rainfall of a 1.5 inch depth over the entire site to simulate natural runoff conditions and reduce small storm discharge to the combined sewer system and manage the 10-year storm and 100-year storm per currently adopted APWA standards. The analysis shall be submitted prior to issuance of any building permits, and the developer shall secure permits to construct any improvements required by the Land Development Division prior to issuance of any certificate of occupancy.

 

13. After the City Plan Commission enters its disposition for the development plan, the developer shall not enter into any agreement that would encumber or otherwise have any impact on the proposed right-of-way dedications for the planned project without the prior written consent of the Land Development Division.

 

14. The developer must integrate into the existing streetlight system any relocated existing streetlights within the street right-of-way impacted by the new drive or approach entrances as required by the Land Development Division, and the relocated lights must comply with all adopted lighting standards.

 

15. The developer shall submit an analysis to verify adequate capacity of the existing sewer system as required by the Land Development Division prior to issuance of a building permit to connect the private system to the public sewer main, and depending on adequacy of the receiving system, make other improvements that may be required.

 

16. The developer shall submit a streetscape plan for approval and permitting by the Land Development Division prior to beginning construction of the streetscape improvements in the public right-of-way, and construct ADA compliant ramps at all required locations where new private drives are being added, or where existing sidewalks are modified or repaired.

 

17. The developer shall cause the area to be platted and processed in accordance with Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, as amended, by making application for a Minor Subdivision and submitting and recording a Lot Consolidation Plat or replatting the property in accordance therewith.

 

18. The project shall be granted a waiver to the right-of-way dedication requirement within the Major Street Plan provided a minimum 5 foot width pedestrian travel path is maintained along all sidewalk frontages, per the recommendation of the Transportation and Development Committee at the October 14, 2019 meeting.

 

19. Buildings shall comply with requirements of wall rating and opening protection per 602 and 705.8 of IBC 2012 with respect to property lines and lot lines.

 

20. The project shall be granted a waiver to the Level of Service requirements as stated within City codes at the intersection of W. 13th Street and Baltimore Avenue due to the existing low Level of Service, per the recommendation of the Transportation and Development Committee at its October 14, 2019 meeting.

 

21. Prior to issuance of any construction permits within a "Combined Sewer Overflow" (CSO) district, the developer shall submit, for review and acceptance, a storm drainage study, sealed by a Missouri-licensed civil engineer, showing detention of the 1.5 inch rainfall depth over the entire disturbed area and release of said volume over a 40- to 72-hour period (unless infiltrated, evaporated, or used in some other manner) in addition to management of the rate and volume of stormwater runoff from the 10% and 1% storms per the latest adopted version of APWA 5600 standards in effect at the time of submission. The developer shall construct improvements necessary to reduce small storm discharges to the combined sewer system by simulating natural runoff conditions through metered release of the 1.5 inch detention volume and mitigate impacts from rate and volume of 10% and 1% storm runoff from the site.

 

22. Stormwater management facilities, including but not limited to detention basins and BMPs, shall be privately maintained and covered by maintenance covenant(s) or easement(s) that include provisions for private maintenance.

 

23. The domestic water and fire service lines must be follow current Kansas City, Missouri Rules and Regulations for water service lines.

 

24. Water meters shall be located outside on private property, in a pit or vault, depending upon the size of the meter. Identify the size and location of the meter and revise the plans accordingly at the time of UR Final Development Plan and permit drawings.

 

25. Update the plans to show that the building will have two separate fire service lines connected to water mains located in different streets at the time of UR Final Development Plan and permit drawings.

 

26. Update the plans to show new fire hydrant(s) will be installed to maintain max 300’ fire hydrant spacing in commercially or mixed zones.

 

27. An operable fire hydrant will be within 100 feet of the building’s Fire Department Connection. (IFC-2012 § 507.5.1.1)

 

28. The developer shall meet high rise requirements to include two water connections on two different streets for fire protection (IFC-2012 § 914.3.1.2), emergency power (IFC-2012 § 604.2.14), fire command (IFC-2012 § 508.1), stair and elevator pressurization.

 

29. The developer shall submit a streetscape plan with street tree planting plan per 88-425-03 for approval and permitting by the Parks and Recreation Department’s Forestry Division prior to beginning work in the public right-of-way.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
