ORDINANCE NO. 000204

 

Authorizing the Director of City Development to enter into a Cooperative Agreement with the Land Clearance for Redevelopment Authority of Kansas City, Missouri, providing for additional conditions for the sale of the Oak Park Fire Station No. 4 property at 3906 Indiana, Kansas City, Missouri.

 

WHEREAS, in furtherance of the Oak Park Urban Renewal Plan and pursuant to Ordinance No. 931407, dated February 17, 1994, the City by Special Warranty Deed, dated October 28, 1994, transferred Old Fire Station No. 4, 3906 Indiana, to the Land Clearance for Redevelopment Authority for use as a community center; and

 

WHEREAS, the City Council in Ordinance No. 991164, dated September 16, 1999, decided that the property may be used by a redeveloper as a community services center or that it may be used by a redeveloper for other purposes that are consistent with the Oak Park Urban Renewal Plan and provide that the City shall receive $16,000.00 if the Authority could net that amount from the sale of the property; and

 

WHEREAS, the City desires to further the advancement of the Oak Park Urban Renewal Plan through the sale of the property for use consistent with the Oak Park Urban Renewal Plan; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That as an additional condition for sale, the Land Clearance for Redevelopment Authority (LCRA) is authorized to sell the property for an amount less than the fair market value of $16,000.00, if, and only if, the purchasers use the property for primary or behavioral health related services, provided the purchaser will covenant, and agree that, in the event the property is sold during a ten year covenant period, they will pay the difference between the reduced price paid and the fair market value of $16,000.00.

 

Section 2. That the Director of City Development is hereby authorized to enter into a Cooperative Agreement with LCRA providing as additional conditions for the sale of the Oak Park Fire Station No. 4, 3906 Indiana, that LCRA is authorized to sell the property for a price less than the fair market value of $16,000.00 if, and only if, the purchasers use the property for primary or behavioral health related services and sign a Covenant agreeing that if the property is subsequently sold within a ten year period, LCRA will receive the difference between the reduced price originally paid and the fair market value of $16,000.00 . The Cooperative Agreement is approved, in substantial form, as that attached to the original of this ordinance.

 


Section 3. That the City Clerk is hereby directed to record copies of the Cooperative Agreement and Covenant in the Office of the Secretary of State for the State of Missouri and the Director of Records for Jackson County, at Kansas City, Missouri as provided by Section 70.300 RSMo.
