COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 120199
Amending Chapters 48 and 56,
Code of Ordinances, by repealing Sections 48-72, Penalty for violation of
chapter, 56-35 Penalty for violation of article, and 56-385, Penalty for
violation of article, and enacting in lieu thereof new sections of like number
and subject matter allowing more flexibility in the punishment of violators.
BE IT ORDAINED BY THE
COUNCIL OF KANSAS CITY:
Section 1. That
Chapter 48, Code of Ordinance of the City of Kansas City, Missouri, is hereby
amended by repealing Sections 48-72, Penalty for violation of chapter, and
enacting in lieu thereof a new section like number and subject matter, to read
as follows:
Sec. 48-72. Penalty for
violation of chapter.
(a)
Any person convicted by a court of a violation of this chapter shall be
punished for that violation by a fine of not less than $85.00 but not more than
$1,000.00, or by imprisonment of not more than 180 days, or by both such fine
and imprisonment.
(b) Every
day that a violation continues shall be considered a separate offense, for
which the violator may be arrested, tried and convicted without necessity of
further notice.
Section 2. That
Chapter 56, Code of Ordinance of the City of Kansas City, Missouri, is hereby
amended by repealing Sections 56-35, Penalty for violation of article, and
56-385, Penalty for violation of article, and enacting in lieu thereof a new
sections of like number and subject matter, to read as follows:
Sec. 56-35. Penalty for
violation of article.
(a)
Any person convicted by a court of a violation of this article shall be
punished for that violation by a fine of not less than $85.00, but not more than
$1,000.00, or by imprisonment of not more than 180 days, or by both such fine
and imprisonment.
(b) Every
day that a violation continues shall be considered a separate offense, for

(c)
The administrative citation fines as described in Sec. 56-36 may also
be imposed for violations of this article and such fines shall be subject to
the administrative fine provisions and processes as described elsewhere in
article II.
