ORDINANCE NO. 200835

 

Amending Committee Substitute for Ordinance No. 190116, which approved a development plan in District R-0.5 on approximately 6 acres generally located at the southeast corner of N.E. 80th Street and N. Spruce Avenue to allow for a senior living facility, by deleting condition 6 and revising condition 12 to delete the requirement for construction of sidewalks along the south side of N.E. 80th Street.

 

WHEREAS, Committee Substitute for Ordinance No. 190116, passed February 14, 2019, approved a development plan in District R-0.5 on an approximately 6 acre tract of land generally located at the southeast corner of N.E. 80th Street and N. Spruce Avenue to allow for a single senior living facility; and

 

WHEREAS, the conditions approving the Ordinance contained a requirement for the construction of sidewalks on the south side of N.E. 80th Street; and

 

WHEREAS, there are no sidewalks that are constructed to the east or the west of the property and to the west of the property are new single family homes that were not required to construct sidewalks along N.E. 80th Street. In addition, current grades at the corner of N. Spruce and N.E. 80th Street have proven difficult to match grades to the existing streets and meet ADA standards;

 

WHEREAS, N. Spruce Avenue is planned to be constructed as Maplewoods Parkway in the future which will contain construction of sidewalks adjacent to this site on the west. At the time of construction of Maplewoods Parkway, improvements (including sidewalks and ADA ramps) would need to be removed and reconstructed in order to match grades of the new parkway; and

 

WHEREAS, the Council now desires to remove the conditions relating to the sidewalk construction for this development plan since there are no connections to the east or west and a great portion will need to be removed when Maplewoods Parkway is constructed in the future; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Committee Substitute for Ordinance No. 190116, passed February 14, 2019, is hereby amended by repealing condition 6 contained in Section A.

 

Section 2. That Committee Substitute for Ordinance No. 190116, passed February 14, 2019, is hereby amended by repealing condition 12 contained in Section A and replacing it with a new condition 12 to read as follows:

 

12. The developer shall improve the south half of N.E. 80th Street as required by Chapter 88, to current standards except sidewalks, including curbs, gutters, streetlights, relocating any utilities as may be necessary and match existing vertical grades for the road, and obtain required permits from the Land Development Division for said improvements prior to issuance of a building permit.

 

Section 3. That all other sections and conditions of Committee Substitute for Ordinance No. 190116 not repealed shall remain in effect.
