COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 030773

 

Amending Chapter 80, Code of Ordinances, by adding a new section to be known as Section 80-11A0495, rezoning an area of approximately 2.9 acres generally bounded by 20th Street on the north, McGee Street on the east, the Kansas City Terminal Railway tracks on the south and Grand Boulevard on the west, from Districts C-3a2 (Intermediate Business, High Buildings) and District M-1 (Light Industry) to District URD (Urban Redevelopment District); approving a development plan for the same (12921-URD); and making certain findings regarding and approving a first amendment to a license agreement with MCZ/Centrum-Western, LLC for property within the area.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0495, rezoning an area of approximately 2.9 acres generally bounded by 20th Street on the north, McGee Street on the east, the Kansas City Terminal Railway tracks on the south and Grand Boulevard on the west, from Districts C-3a2 (Intermediate Business, High Buildings) and District M-1 (Light Industry) to District URD (Urban Redevelopment District), said section to read as follows:

 

Section 80-11A0495. That an area legally described as:

 

All that part of Lots 98 thru 106 inclusive, Lots 107 thru 111 inclusive, and Tracts A and B of Union Station Addition, all that part of Lots 7 thru 16 inclusive, Block 2, Adams First Addition, all that part of Lots 5 thru 9 inclusive, Block 1, Adams Second Addition, all that part of alley lying east of Lots 98 thru 106 inclusive, Union Station Addition, all being subdivisions in Kansas City, Jackson County, Missouri, along with all that part of 21st Street between Grand Avenue and McGee Street, and together with areas to be used for parking lying under the Grand Avenue and McGee Street Viaducts, said project area being more particularly described as follows: Beginning at the northwest corner of Lot 98, Union Station Addition, said corner also being on the east right-of-way of Grand Avenue; thence North 89E41'02" East along the north line of said Lot 98 and extension thereof a distance of 132.18 feet to a point on the west line of Lot 7, Block 2, Adams First Addition, said line also being the east line of alley; thence North 00E43'22" West along the west line of Lot 7, Block 2, Adams First Addition a distance of 21.50 feet to the northwest corner of Lot 7, Block 2, Adams First Addition; thence North 89E36'09" East along the north line of Lot 7, Block 2, Adams First Addition a distance of 115.43 feet to the northeast corner of Lot 7, Block 2, Adams First Addition, said line also being the west right-of-way line of McGee Street; thence South 00E42'27" East along the west right-of-way line of McGee Street a distance of 53.50 feet; thence South 89E36'15" West along the west right-of-way line of McGee Street a distance of 3.50 feet; thence South 00E42'27" East along the west right-of-way line of McGee Street, a distance of 89.59 feet; thence North 89E41'03" East, a distance of 73.00 feet to a point on the


east line of an additional right-of-way easement for McGee Street as described in Document No. K-598627, Book K-1283, page 19841; thence South 00E42'27" East along said easement a distance of 163.11 feet to a point on the north line of Lot 1, Block 2, Adams Second Addition; thence South 89E33'41" West along the north line of Lot 1, Block 2, Adams Second Addition, a distance of 3.50 feet to the northwest corner of Lot 1, Block 2, Adams Second Addition; thence South 00E42'27" East along the west line of Lot 1, Block 2, Adams Second Addition, a distance of 19.40 feet; thence South 77E09'23" West, a distance of 19.87 feet to a point of curve; thence in a southwesterly direction along a curve to the left, being tangent to last course and a radius of 427.29 feet, an arc distance of 78.73 feet; thence South 66E35'59" West. a distance of 136.80 feet to a point of curve, said point being on the east line of access easement; thence in a southwesterly direction along a curve to the right, having an initial tangent bearing of South 29E26'41" West and a radius of 222.86 feet, an arc distance of 86.31 feet; thence South 89E15'11" West, a distance of 36.09 feet to a point on the east right-of-way line of Grand Avenue; thence North 00E42'00" West along the east right-of-way line of Grand Avenue a distance of 6.08 feet; thence South 89E13'20" West, a distance of 99.00 feet to the west right-of-way line of Grand Avenue; thence North 00E45'03" West along the west right-of-way line of Grand Avenue a distance of 87.39 feet; thence North 89E33'41" East, a distance of 49.50 feet to the center of Grand Avenue; thence North 00E45'03" West along the center of Grand Avenue a distance of 133.33 feet; thence North 89E41'03" East, a distance of 49.50 feet to the east right-of-way of Grand Avenue; thence North 00E44'49" West along the east right-of-way of Grand Avenue a distance of 225.00 feet to the point of beginning. Containing 125,399 square feet or 2.879 acres. All bearings based on the east right-of-way line of Grand Avenue as having a bearing of North 00E44'49" West.

 

is hereby rezoned from Districts C-3a2 (Intermediate Business, High Buildings) and District M-1 (Light Industry) to District URD (Urban Redevelopment District), all as shown outlined on a map marked Section 80-11A0495, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a macro storm drainage study for the entire development to the City Engineers Office for approval when the first plat is submitted and a detailed micro storm drainage study for each phase at the time of final platting and that the developer construct any improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre, including providing security equal to the estimated cost to install and maintain the approved erosion and sediment control measures for the duration of the land disturbance permit.

 

5. That the developer receive the approval of the Kansas City Terminal Railway prior to working within the railroad right of way.

 

6. That the developer secure permits to construct sidewalks and repair existing street curb and gutters, including catch basins, on the east side of Grand Boulevard and the west side of McGee Street as required by the Department of Public Works and the Department of Parks and Recreation prior to recording of any final plat.

7. That the developer integrate any relocated or reconstructed streetlights into the existing streetlight system as required by the Department of Public Works.

 

8. That the developer obtain the grading consents and all grading, temporary construction and drainage easements from abutting property owners prior to submitting any public improvements.

 

9. That the developer submit a streetscape plan for approval and permitting by the Department of Public Works and the Department of Parks and Recreation as required prior to beginning any work within the public right of way.

 

10. That the developer extend sanitary and/or storm sewers and determine their adequacy as required by the Department of Public Works.

 

11. That the developer petition for the vacation of 21st Street and the adjacent north-south alley as shown on the development plan.

 

12. That the developer dedicate right of way for, and construct, a public turnaround at the south end of the remaining public alley as shown on the development plan, as required by the Department of Public Works.

 

13. That the developer receive approval of a Code Modification Request for the parking area dimensions.

 

14. That the developer contribute $22,550.32 in lieu of parkland dedication for 165 multi-family units (165 x 2.0 x 0.006 x $11,389.05) in satisfaction of Section 66-128 of the Subdivision Regulations.

15. That the developer submit a final plan to the Director of City Development for approval, including detailed information on landscaping, signage (including elevations), lighting and building elevations.

 

16. That the revisions to the development plan as shown on Exhibit A attached to this ordinance be incorporated in the final plan.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 030773, which is attached hereto and made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.

 

Section D. That the Council hereby finds and determines that the real property licensed to MCZ/Centrum-Western, LLC (Property) under the License Agreement between the City and MCZ/Centrum-Western dated June 24,2003 (License Agreement) and the first amendment thereto is retained for use as a public street of the City (the City hereby disclaiming any intent to abandon or vacate the Property as a public street), that the access limitations permitted by the License Agreement and the first amendment thereto are reasonable, in light of, among other things, the current dead-end nature of the public streets within the Property, that the License Agreement provides for a secondary use of the Property which is not inconsistent with its use as a public street and that the License Agreement and first amendment thereto further the interests of the City and the public in aiding redevelopment of a blighted area and the restoration of a historic structure.

 

Section E. That the Director of City Development is hereby authorized to execute a first amendment to the License Agreement between the City and MCZ/Centrum-Western, LLC dated June 24, 2003. The amendment provides reasonable access to UMB Bank, na,, the owner of certain abutting real property, to the property licensed to MCZ/Centrum-Western, LLC. and is hereby approved in substantial form as that on file in the office of the Director of City Development.
