ORDINANCE NO. 961637
Amending Chapter 80, Code of Ordinances of the City of
Kansas City, Missouri, 1996, commonly known as the Zoning Ordinance, by adding
a new section to be known as Section 80-11A0011, rezoning an area of
approximately .76 acres generally located at the southwest corner of N.E. 88th
Street and N. Oak Trafficway from District R-1a (One-Family Dwellings) to
District R-4-p (Low Apartments - Limited District), and approving a preliminary
plan for the same. (11894-P)
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section A. That Chapter 80, Code of Ordinances of
the City of Kansas City, Missouri, 1996, commonly known as the Zoning
Ordinance, is hereby amended by enacting a new section to be known as Section
80-11A0011, rezoning an area of approximately .76 acres generally located at
the southwest corner of N.E. 88th Street and N. Oak Trafficway from District
R-1a (One-Family Dwellings) to District R-4-p (Low Apartments - Limited
District), said section to read as follows:
Section 80-11A0011. That an area legally described
as:
The East 1/2 of Lot 1, Gashland Resurvey, a
subdivision in the City of Kansas City, Clay County, Missouri, except a
tract of land in Lot 1, Gashland Heights Resurvey, a subdivision in the
Northwest Quarter of Section 11, Township 51 North, Range 33 West, in
Kansas City, Clay County, Missouri, more particularly described as
follows: Beginning at the southeast corner of Lot 1, being a point on the
west right-of-way line of N. Oak Trafficway; thence South 89 54'01"
West along the south line of Lot 1, a distance of 20.00 feet; thence North
00 40'34" East, being 50.00 feet west of and parallel with the east line
of the Northwest Quarter of Section 11, a distance of 169.66 feet to a
point of curvature of a curve to the left, having a central angle of 90
46'33" and a radius of 25.00 feet; thence northwesterly along the arc of
that curve, a distance of 39.61 feet; thence South 89 54'01" West,
being 5.00 feet south of and parallel with the north line of Lot 1, a
distance of 144.67 feet to the west line of the property recorded in Book
2250, page 890; thence North 00 40'34" East along that line, a distance
of 5.00 feet to the south right of way line of N.E. 88th Street; thence
North 89 54'01" East along that south right of way line, a distance of
190.00 feet to the west right of way line of N. Oak Trafficway; thence
South 00 40'34" West along that west right of way line a distance of
200.00 feet to the point of beginning.
is hereby rezoned from District R-1a (One-Family
Dwellings) to District R-4-p (Low Apartments - Limited District), all as shown
outlined on a map marked Section 80-11A0011, which is attached hereto and made
a part hereof, and which is hereby adopted as a part of an amendment to the
zoning maps constituting a part of said chapter and as an amendment to Section
80-11 thereof.
Section B. That a preliminary plan for the area
legally described above is hereby approved. A copy of said preliminary plan is
on file in the office of the City Clerk under Document No. 961637, which is
attached hereto and made a part hereof.
Section C. That the Council finds and declares that
before taking any action on the proposed amendment hereinabove, all public
notices and hearings required by the Zoning Ordinance have been given and had.
