COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 090309

Authorizing the Director of Public Works to execute a 3 year contract with Town and Country Disposal of Western Missouri, Inc., beginning May 1, 2009, to provide weekly curbside collection and processing of recyclable materials; authorizing the Director of Public Works to exercise two one-year renewals of the contract, for a possible total of 5 years; and declaring an emergency.

  WHEREAS, the City solicited proposals for the operation of its curbside recyclable materials collection and processing program beginning May 1, 2009; and

WHEREAS, Town and Country Disposal of Western Missouri, Inc. (Town and Country) was determined to be the best proposer and has been selected to provide this service; and

WHEREAS, Town and Country will assume full operation of the curbside recyclable materials collection and processing for every part of the City not being serviced by the City employees; and

WHEREAS, the services will continue to be provided on a weekly basis such that residents will experience no disruption or change in services as they presently exist; and

WHEREAS, this contract will include the participation of a certified minority business enterprise for the life of the contract; and

WHEREAS, funds have been appropriated for the fiscal year beginning May 1, 2009; and

WHEREAS, the continuation of the contract for all or part of subsequent fiscal years is contingent upon the future appropriation of funds for that purpose; and

WHEREAS, an emergency exists in that Citys existing contract for recycling services expires April 30, 2009 and the City will be unable to provide this essential service as of May 1, unless the contract referenced herein in effectively authorized, such that public health will be impaired as recyclable materials will go uncollected and will accumulate in the public right-of-way or otherwise be discarded as trash thereby consuming limited landfill space; NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the Director of Public Works is authorized to execute, on behalf of City, a 3 year contract with Town and Country for curbside collection and processing of recyclable materials and to expend $2,501,057.00 from funds previously appropriated to Account No. 10-1000-892330-B, to satisfy the Citys obligations under the contract for the period of May 1, 2009 through April 30, 2010.

Section 2. That the contract may be extended by the Director of Public Works for up to two additional one-year periods.

Section 3. That the continuation of this contract, and any extension thereof, beyond the fiscal year ending April 30, 2010 shall be contingent upon the annual appropriation of funds for that purpose.

Section 4. That the contract authorized herein is approved in substantial form as that on file in the office of the Director of Public Works.

Section 5. That this ordinance is declared an emergency measure within the provisions of Section 503 of the City Charter in that it relates to the immediate preservation of the public health, and shall take effect in accordance with that section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
