COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 140760

 

Amending Chapter 2, Article VI of the Code of Ordinances, entitled “Boards, Commissions and Committees,” by enacting a new Division 20 consisting of Sections 2-970.40 through 2-970.45 entitled “Climate Protection Steering Committee” to formally establish an official climate protection steering committee.

 

WHEREAS, the City Council on August 17, 2006, adopted a resolution directing the City Manager to undertake a climate protection planning process for Kansas City; and

 

WHEREAS, an eleven member steering committee of community leaders was appointed to oversee the planning process and work with City administration to develop a climate protection plan; and

 

WHEREAS, the Climate Protection Steering Committee prepared a climate protection plan to reduce greenhouse gas emissions and achieve other high priority goals for the City, which was adopted by the City Council on July 24, 2008 (the “Climate Protection Plan”); and

 

WHEREAS, it is the City Council’s intent that the Climate Protection Steering Committee continue to serve as an ongoing advisor regarding implementation of the Climate Protection Plan; and

 

WHEREAS, it is the appropriate time to clearly define the City Council’s vision for the purpose of the Climate Protection Steering Committee now and in the future; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Chapter 2, Article VI of the Code of Ordinances, entitled “Boards, Commissions and Committees,” is hereby amended by enacting a new Division 20 entitled “Climate Protection Steering Committee” consisting of Sections 2-970.40 through 2-970.45 to formally establish an official climate protection steering committee, said sections to read as follows:

 

DIVISION 20. CLIMATE PROTECTION STEERING COMMITTEE.

 

Sec. 2-970.40. Purpose.

The Climate Protection Steering Committee will assist and support city leadership by serving as an advisory body to the Mayor, City Council and City Manager on matters related to climate protection.


 

Sec. 2-970.41. Establishment; membership; appointment of members.

 

The Climate Protection Steering Committee shall consist of eleven members, appointed by the Mayor. One member shall be appointed to the committee from each of the following entities or groups:

 

(1) At least one member shall be a representative of the City’s Environmental Management Commission.

 

(2) At least one member shall be a representative of the business community within the city.

 

(3) At least one member shall be a representative of the utility or energy production sector within the city.

 

(4) At least one member shall be a representative of the non-profit sector within the city.

 

All members shall be residents of the city, except that up to four members may live outside of the city, provided that they personally contribute to the city's earnings tax.

 

Sec. 2-970.42. Duties.

 

The committee shall advise the City Council on the implementation of the City’s Climate Protection Plan. The committee shall also review plans, budgets, programs and actions of the city which significantly reduce greenhouse gas emissions while preserving economic development, transportation options and the ability of responsible producers of energy to provide a stable and cost-effective energy supply. The committee shall advise the City Council as to important developments related to the Climate Protection Plan as appropriate.

 

Sec. 2-970.43. Terms.

 

Each member shall be appointed for a three-year term. The terms shall be staggered. To effectuate a staggering of terms, three of the initial appointments shall be for one year, four of the initial appointments shall be for two years, while the remainder shall be for three years. All members shall continue to serve until their respective successors shall have been appointed. They may thereafter be reappointed at the pleasure and discretion of the Mayor. Vacancies shall be filled for the unexpired term of any member whose seat shall be vacant.

 

Sec. 2-970.44. Meetings; Rules and Procedures.

 

The committee shall meet a minimum of four times per year at a time and place determined by the committee. The members of the committee shall serve without compensation and shall be subject to removal by the Mayor. The committee shall elect its own chair and vice-chair. The committee may adopt, from time to time, those rules and regulations as it may deem necessary to effectuate its purpose and govern its affairs.

 

Sec. 2-970.45. Staff Support.

 

The City Manager’s Office of Environmental Quality shall provide clerical and administrative services for the committee.
