ORDINANCE NO. 021440
Authorizing execution of a
Driveway Access Easement Agreement with Great Corner-Frolics, L.L.C., for
access and maintenance of a driveway, through a portion of City property east
of grantees property at 7101-15 and 21 N.W. Barry Road and lying south of N.W.
Barry Road and directing the City Clerk to record same.
WHEREAS, it has
been determined that an easement is necessary for access and maintenance of a
driveway around the east side of the building at 7101-15 and 21 N.W. Barry
Road, in, under, over and through a portion of City property east of said
building and lying south of N.W. Barry Road; NOW, THEREFORE,
BE IT ORDAINED BY
THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Public Works is hereby authorized to execute a Driveway Access
Easement Agreement, on behalf of the City, granting an access easement in,
under, over and through a portion of City property in Kansas City, Platte
County, Missouri, which is legally described as follows:
A tract
of land in the Southeast Quarter of Section 12, Township 51, Range 34, in
Kansas City, Platte County, Missouri; more particularly described as follows:
Commencing at the northeast corner of Frolics Plaza, a subdivision in said
city, county and state according to the recorded plat thereof; thence along a
line with an assumed bearing of South 0E09'41"
West, said line being the easterly line of said Frolics Plaza, a distance of
131.90 feet to the point of beginning of the tract of land to be herein
described; thence South 89E50'19" East,
perpendicular to the last described course, a distance of 5.30 feet; thence
South 0E09'41" West, perpendicular to the last described
course and parallel with the easterly line of said Frolics Plaza, a distance
of 136.00 feet; thence North 89E50'19" West,
perpendicular to the last described course, a distance of 5.30 feet to a point
on the easterly line of said Frolics Plaza, said point being 22.10 feet north
of the southeast corner of said Frolics Plaza as measured along the easterly
line thereof; thence North 0E09'41" East along the
easterly line of said Frolics Plaza, a distance of 136.00 feet to the point of
beginning. Containing 720.8 square feet, more or less.
Reference
to said Frolics Plaza is for informational purposes only and not included in
the tract of land as described above.
Section 2. That
the City Clerk is hereby directed to record this Ordinance in the office of the
Director of Records for Platte County, Missouri at Platte City.
