Amending Ordinance No. 020876
passed on August 1, 2002, Ordinance No. 011729 passed on August 29, 2002, and Ordinance No. 011599 passed on December 20, 2001, for the purposes of modifying the permit fee for hauling dirt, rock or similar materials, the
application and permit fee for traffic control, and the permit fee for parades;
and amending Chapter 64, Code of Ordinances, by repealing Section 70-562,
Permits for Loading Zones, and enacting in lieu thereof a new section of like
number and subject matter.
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1.
That Ordinance No. 020876 passed on August 1, 2002, which established permit
fees for hauling dirt, rock or similar materials, is hereby amended by
repealing Section (b) thereof, and enacting in lieu thereof a new section of
like designation and subject matter, to read as follows:
Sec. 64-8. Hauling, dirt,
rock, or similar materials.
(b) Permit
fee. The fee for such permit issued by the director of public works shall
be $10.00 plus $0.003 per cubic yard as estimated by the engineer or architect.
Section 2. That
Ordinance No. 011729 passed on August 29, 2002, which established application
and permit fees for traffic control, is hereby amended by repealing the
definition of unit cost within Section (a) thereof, repealing Section (c)
thereof, and repealing Section (g)(6) thereof, and enacting in lieu thereof a
new definition of unit cost and sections of like designation and subject
matter, to read as follows:
Sec. 70-39. Authority of
director to close streets, sidewalks and other travelways;
authority
to establish emergency parking restrictions.
(a) Definitions.
As used in this section:
Unit cost
(UC) shall be $0.15 per linear mile which shall be adjusted annually to the
nearest cent by the director to reflect the change in the consumer price index
(all items/all urban consumers/Kansas City, Missouri/Kansas) published by the
United States Department of Labor, Bureau of Labor Statistics.
(c) Application
fee. An application fee of $75.00 shall accompany each application
for a traffic control permit. The application fee is to defray the various
costs incurred by the city in investigating and processing the applications and
issuing the permit and inspection of the site of the traffic control. The
application fee is not refundable.
(g) Annual
permits.
(6) If approved by the director for an annual
traffic control permit, payment of the annual traffic control permit fee to the
city in the amount of $300.00
Section 3. That
Ordinance No. 011599 passed on December 20, 2001, which established procedures
for permitting parades, is hereby amended by repealing Section (d) and (e)
thereof, and enacting in lieu thereof new sections of like designation and
subject matter, to read as follows:
Sec. 70-263. Permit for
parades, processions and races.
(d) Application.
A permit for a parade shall not be issued unless a written application therefor
has been filed in the form prescribed by the director not less than seven
business days, not including the day that the application is filed, before the
proposed parade. Each application shall be accompanied by a fee of $50.00.
Unless the parade has a commercial sponsorship, or an entry fee for
participation in the parade, this fee may be waived if parade is a city
sponsored event or if the applicant has obtained a waiver from the director
pursuant to standards for waiver set forth in this section. Each application
shall include the following information regarding the parade.
(1) The name and address of the person filing the
application and the name of each sponsor.
(2) If
applicable, the name and address of the organization.
(3) The
proposed date(s) of the parade.
(4) The time of set up, commencement, termination
and cleanup of the streets, sidewalks and surrounding areas.
(5) The
route and maximum length of the parade route.
(6) The
number of people and vehicles taking part.
(7) The
area of the right of way to be reserved for the parade.
(8) If
the parade is covered by insurance provided by the applicant or
sponsor, a
certificate showing the city as an additional insured.
(e) Documents
required. Each application shall be accompanied by the following
documents:
(1) Commitment that the applicant and sponsor
organization are responsible for post-parade cleanup on the streets, sidewalks
and other public ways.
(2) Certification that the applicant or sponsor
organization have, not less than five business days prior to the proposed
event, notified in writing all owners of property adjacent to the proposed
parade route, of the name of the event; name of the sponsor organization
including mailing address and telephone number; date, starting and ending times
of the event; and the detailed description of the route.
(3) The certification shall include a list of all
the addresses along the proposed parade route where and persons residing or
doing business at those addresses have been notified of the proposed parade.
(4) A traffic control plan, including methods,
devices and who will be responsible for controlling traffic.
Section 4. That
all provisions and sections of Ordinances No. 020876, 011729, and 011599 not
repealed and reenacted above shall remain effective.
Section 5. That
Chapter 64, Code of Ordinances, is hereby amended by repealing Section 70-562,
Permits for Loading Zones, and enacting in lieu thereof a new section of like
number and subject matter, to read as follows:
Sec. 70-562. Permits for
loading zones.
(a) The
director shall not designate or sign any loading zone upon special request of
any person unless such person makes application for a permit for such zone and
for signs to indicate the ends of each such zone. The application shall be
accompanied by a deposit of $15.00, which shall apply to the annual fee if such
loading zone is approved and which shall be returned to the applicant if the
request for the loading zone is denied. The director, upon granting a permit,
shall collect from the applicant and deposit in the city treasury an annual
service fee of:
(1) In an area bounded on the south by Truman
Road, on the north by 6th Street, on the west by Washington Avenue, and on the
east by Harrison Street.
a. Five dollars for each foot of such loading
zone when such space is available during any of the nighttime hours between
6:00 p.m. and 7:00 a.m.
b. Seventeen dollars for each foot of such
loading zone when such space is available during any of the daytime hours
between 7:00 a.m. and 6:00 p.m. or 24 hours per day.
(2) In
all other areas:
a. Five dollars for each foot of such loading
zone when such space is available during any of the nighttime hours between
6:00 p.m. and 7:00 a.m.
b. Ten dollars for each foot of such loading zone
when such space is available during any of the daytime hours between 7:00 a.m.
and 6:00 p.m. or 24 hours per day.
(b) Every
such permit shall expire at the end of one year.
