ORDINANCE NO. 940758

 

Authorizing the Director of Housing and Community Development Department to execute a First Right of Refusal and a sales contract with the Department of Housing and Urban Development for $1.00 for property located at 5654 Norton commonly known as Friendship Village Apartments; authorizing the Director of Housing and Community Development Department to enter into a cooperative agreement with Land Clearance for Redevelopment Authority for subsequent sale and redevelopment and rehabilitation of the property; and directing the City Clerk to record said cooperative agreement with the Secretary of State and the Director of Records.

 

WHEREAS, the Department of Housing and Urban Development owns the property at 5654 Norton commonly known as Friendship Village Apartments; and

 

WHEREAS, the Department of Housing and Urban Development has offered to sell the property pursuant to the 1988 Technical Amendments to the Housing and Community Development Act of 1987, which gives state and local government agencies a "Right of First Refusal" to purchase HUD owned rental housing properties once HUD has developed a final disposition plan; and

 

WHEREAS, the City desires to execute said "Right of First Refusal" for purchase and subsequent transfer to the Land Clearance for Redevelopment Authority to sell for redevelopment and rehabilitation; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Council does hereby approve and authorize the purchase of HUD property located at 5654 Norton in Kansas City, Jackson County, Missouri, commonly known as Friendship Village Apartments for $1.00.

 

Section 2. That the Council does hereby approve and authorize a cooperative agreement between the City and the Land Clearance for Redevelopment Authority transferring said property to Land Clearance for Redevelopment Authority to sell for redevelopment and rehabilitation of the property. A copy of said cooperative agreement, in substantial form, is attached hereto and made a part hereof.

 

Section 3. That the City Clerk is hereby directed to record copies of the cooperative agreement in the Office of the Secretary of State for the State of Missouri and the Director of Records for Jackson County, Missouri at Kansas City as provided by State Statute Section 70.300.
