COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 170772

 

Amending Chapter 18, “Buildings and Building Regulations,” Article II, Section 18-40, to enact provisions for regulation of short term rental. 

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1.  That Chapter 18 of the Code of ordinances, “Buildings and Building Regulations,”  Article II, Section 18-40, is hereby amended by repealing subsections 202 and 310.5.1 and replacing said subsections with new subsections of like number and title, and by enacting new subsections 310.4.1, 310.5 and 310.5.2, said new subsections to read as follows:    

SECTION 202 – DEFINITIONS

 

The following definitions have been revised or added (remainder of Section 202 unamended):

 

HISTORIC BUILDINGS. Buildings that are listed in the National Register of Historic Places, or designated as historic under an appropriate state or local law (see Sections 3409 and 3411.9).

 

LODGING HOUSE. A one-family dwelling where one or more occupants are primarily permanent in nature, rent is paid for guest rooms.

 

[A] OWNER. Any person, agent, operator, entity, firm or corporation having any legal or equitable interest in the property; or recorded in the official records of the state, county or municipality as holding an interest or title to the property; or otherwise having possession or control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.

 

 

310.4.1 Short Term Rental units. Residential occupancies of occupancy classification R-2, where a maximum of 25% of the units in a building are Short Term Rental units, shall be permitted to be considered primarily non-transient in nature.

 

310.5 Residential Group R-3. Residential occupancies where the occupants are primarily permanent in nature and not classified as Group R-1, R-2, R-4 or I, including:

Buildings that do not contain more than two dwelling units

Boarding houses (nontransient) with 16 or fewer occupants

Boarding houses (transient) with 10 or fewer occupants

Care facilities that provide accommodations for five or fewer persons receiving care

Congregate living facilities (nontransient) with 16 or fewer occupants

Congregate living facilities (transient) with 10 or fewer occupants

Lodging houses (transient) with five or fewer guest rooms and 10 or fewer occupants

 

310.5.1 Care facilities within a dwelling. Care facilities for five or fewer persons receiving care that are within a single-family dwelling are permitted to comply with the International Residential Code.

 

310.5.2 Lodging houses. Owner-occupied lodging houses (in which the owner lives in common with the guests) with five or fewer guest rooms and 10 or fewer total occupants shall be permitted to be constructed in accordance with the International Residential Code.
