ORDINANCE NO. 940040

 

Granting a temporary permit to Twin Cities Service, Inc., d/b/a American Eagle Charters, Inc., (TSC) to operate a public bus service on the streets of Kansas City as a part of its bus service operation to and from Blue Springs, Missouri; establishing a permit fee of $500.00 per vehicle and establishing conditions of the permit.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That Twin Cities Service, Inc., d/b/a American Eagle Charters, Inc., (TSC) is hereby granted, subject to compliance with all of the terms and conditions hereof, the temporary right and privilege to operate a public bus service on the streets of Kansas City, Missouri, in conjunction with the bus service it operates to and from Blue Springs, Missouri. The permittee is granted no property interest capable of being encumbered or assigned.

 

Section 2. That such bus service shall be operated over only such routes and shall serve only such stops as shall be approved by the Director of Public Works.

 

Section 3. That the permittee, shall pay an annual permit fee of $500.00 per vehicle operated in service in Kansas City, Missouri, to cover the City's costs of regulating the operations of the permittee hereunder and the costs associated with the permittee's use of the City's streets.

 

Section 4. That the permittee shall indemnify and hold the City, its officers, agents and employees, harmless from all liability, loss or damage resulting to any persons or property caused by or arising out of the permittee's operations hereunder; and shall provide the City with a certificate of liability insurance by a carrier approved by the Director of Finance covering the indemnification agreement having a combined single limit of five million dollars. The insurance policy, by separate endorsements, shall name the City as an additional insured and agree to provide thirty (30) days notice to the City prior to any change in, or cancellation of, said insurance.

 

Section 5. That the permittee shall not compete with the Kansas City Area Transportation Authority for local service within Kansas City but serve a limited number of transfer points in downtown Kansas City and Crown Center where passengers can flow from one carrier to another.

 

Section 6. The rights and privileges granted hereunder shall continue until revoked by action of the Council and shall automatically terminate upon the failure of the permittee to comply, or continue to comply, with any of the conditions hereof.
