ORDINANCE NO. 961620

 

Approving and authorizing settlement of a lawsuit styled Scope Pictures of Missouri, Inc., and Main Street Realty Co., Inc. v. City of Kansas City, Missouri, Case No. 96-0488-CV-W-8 by payment of $44,000.00.

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the settlement of the claims of Scope Pictures of Missouri, Inc., and Main Street Realty Co., Inc., alleging denials of rights protected by the First and Fourteenthnplantingofaminimumwidthof20feetandaheightadequatetoprovideaprotectivescreenforadjoiningresidentialuses;providedthatforanyfuneralhomewhichislocatedwithinacemeteryconsistingofatleast50acresoflandnoscreeningshallberequiredfromthecemeteryproperty;and

(#[1] ashallbewithin25feetoftheboundaryofanadjoiningpropertywhichislocatedinanR1toR5district,inclusive.Providedthatforanyfuneralhomewhichislocatedwithinacemeteryconsistingofatleast50acresoflandnosetbacksshallberequiredfromthe
