THIRD COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 011510

 

Approving a Community Unit Project on an approximately 35.5 acre tract of land generally located on the east side of N.W. Waukomis Drive approximately 1,000 feet south of N.W. 64th Street. (11777-CUP-7)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a Community Unit Project on an approximately 35.5 acre tract of land generally located on the east side of N.W. Waukomis Drive approximately 1,000 feet south of N.W. 64th Street, and more specifically described as follows:

 

Lot 1, Flickers Addition, a subdivision in Kansas City, Platte County, Missouri, and Tract B, Clayton Meadows West, a subdivision in Kansas City, Platte County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development to the City Engineers Office for approval and that the developer make any necessary improvements as required by the City Engineers Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to the commencement of any construction activities.

 

4. That the developer secure a land disturbance permit from the Department of Public Works prior to beginning any construction, grading, clearing or grubbing activities, if the disturbed area exceeds one acre.

 

5. That the developer secure a land disturbance permit from the Missouri Department Resources.

 

6. That the developer install hard surface roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer extend water mains as required by the Water Services Department.

 

8. That the developer construct a left turn lane on N.W. Waukomis Drive as required


by the Department of Public Works and the Board of Parks and Recreation Commissioners.

 

9. That the developer construct a temporary cul de sac at the east end of N.W. 63rd Street as required by the Department of Public Works.

 

10. That the developer secure a floodplain certificate from the Department of Codes Administration prior to beginning any construction activities within the floodplain.

 

11. That the developer show the limits of the floodplain on the final plat as required by the Department of Public Works.

 

12. That the developer prepare a Section 106 Cultural Resource Assessment on the property prior to any construction activities.

 

13. That the developer submit a street tree planting plan as part of the final plat with a copy to be submitted to the Department of City Development, secure the approval of the City Forester for street trees planted on right of way in front of residential lots, and plant the street trees in conformance with the plan approved by the City Forester. The plan shall include size, type, species and placement of trees.

 

14. That the developer receive the approval of the Board of Zoning Adjustment of a conditional use permit for the residential identification signs.

 

15 That the developer contribute $27,356.86.00 in lieu of parkland dedication for 176 units (176 units x 2.0 x .006 x $12,953.06) in satisfaction of Section 66-128 of the Subdivision Regulations.

 

16. That the developer submit a final plan for each phase to the City Plan Commission for approval, including detailed information on landscaping, signage (including elevations), and building elevations, to show similar materials, windows and porches on the front and rear of each residential structure, and that any trash or mailbox enclosures be of materials similar to the residential structures.

 

A copy of said Community Unit Project plan is on file in the office of the City Clerk under Document No. 011510, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed Community Unit Project hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
