ORDINANCE NO. 001482

 

Approving a development plan in District GP-7 (Agricultural and Low-Density Residential Uses) on approximately a 60 acre tract of land generally located on the north side of N.W. Barry Road, approximately 2000 feet east of N. Childress Avenue. (12468-GP)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That a development plan in District GP-7 (Agricultural and Low-Density Residential Uses) on approximately a 60 acre tract of land generally located on the north side of N.W. Barry Road, approximately 2000 feet east of N. Childress Avenue, and more specifically described as follows:

 

TRACT 1: The north 10 acres of even width of the Northwest Quarter of the Northwest Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri.

 

TRACT 2: The Northeast Quarter of the Northwest Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri.

 

TRACT 3: The east 30 acres of even width of the Southeast Quarter of the Northwest Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri, except a certain tract of land beginning at a point 724 feet west (measured along the center of the highway) of the center of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri, thence north 363 feet; thence west 120 feet; thence south 363 feet to the center of highway; thence east 2120 feet to the point of beginning. Also, except, a part of the Southeast Quarter of the Northwest Quarter of Section 10, Township 51, Range 34, Kansas City, Platte County, Missouri; beginning at a point in the Quarter Section line 870 feet west of the center of Section 10; thence north 363 feet to a stake; thence west parallel to the Quarter Section line, 120 feet to a stake; thence south parallel to the east line of the tract 363 feet to the Quarter Section line, a point 120 feet west of the point of beginning and also excepting those portions heretofore conveyed to the State of Missouri for highway purposes.

 

is hereby approved, subject to the following conditions:

 

1. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

2. That the developer secure permits from the Department of Public Works prior to beginning any work in the Citys right of way.

 


3. That the developer comply with the Kansas City International Airport height regulations as required by the City.

 

4. That the developer grant an Aviation and Noise Easement to the City as required by the Aviation Department prior to the approval of a final plan.

 

5. That the developer submit a final plan to the City Plan Commission for approval, including plans for landscaping, screening, grading and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk under Document No. 001482, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
