COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 971631

 

Approving the preliminary plat of Mace Valley on a 6. 3 acre tract of land generally located on the south side of N.W. 78th Street, east of N. Mace Road. (SD 0770)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Mace Valley on a 6.3 acre tract of land generally located on the south side of N.W. 78th Street, east of N. Mace Road, and more specifically described as follows:

 

All that part of the Northwest Quarter of Section 13, Township 51, Range 34, in the City of Kansas City, Platte County, Missouri, described as follows: Beginning at the most southwesterly corner of Lot 78, Squires Hill Second Plat, a subdivision of land in the City of Kansas City, Platte County, Missouri; thence South 6551'04" East, along the southwesterly line of Lots 78, 79, and 80, of said Squires Hill Second Plat, a distance of 336.85 feet, to the most southeasterly corner of said Lot 80; thence South 4411'46" West, a distance of 509.61 feet, to a point on the south line of the Northwest Quarter of the Northwest Quarter of said Section 13; thence North 8947'30" West, along the south line of the Northwest Quarter of the Northwest Quarter of said Section 13, a distance of 337.84 feet, to a point on the centerline of Mace Road; thence North 0428'43" West, along the centerline of Mace Road, a distance of 505.09 feet; thence South 8947'06" East, along a line parallel to the north line of the Northwest Quarter of the Northwest Quarter of said Section 13, a distance of 425.17 feet to the point of beginning. Said tract contains 6.26 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study to the City Engineers Office for approval and that improvements be made as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineers Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer extend water mains as required by the Water Services Department.

 


6. That the developer construct hard surface all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond foundations.

 

7. That the developer submit a street tree planting plan for approval with the final plat and secure the approval of the City Forester. The street tree planting plan shall include size, species and spacing of street trees.

 

8. That the developer contribute $3,162.43 in lieu of parkland dedication for 17 single family units in satisfaction of Section 66-128 of the Subdivision Regulations.

 

9. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

10. That the developer dedicate additional right of way for N. Mace Road as required by the Department of Public Works so as to provide 40 feet of right of way as measured from the centerline of N. Mace Road.

 

11. That the developer improve one-half of N. Mace Road to secondary arterial street standards as required by the Department of Public Works.

 

12. That the developer construct sidewalks on the east side of N. Mace Road as required by the Department of Public Works.

 

13. That the developer comply with the Kansas City International Airport height zoning restrictions and that no structure in this area be constructed exceeding these restrictions.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 971631, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
