ORDINANCE NO. 140714

 

Rezoning a 1.51 acre tract of land generally located at the southwest corner of N. Church Road and N.E. 81st Terrace from District O-2 to District B3-2. (9815-P-75)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 88, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning and Development Code, is hereby amended by enacting a new section to be known as Section 88-20A0971, rezoning an approximately 1.51 acre tract of land generally located at the southwest corner of N. Church Road and N.E. 81st Terrace from District O-2 (Office (dash 2)) to District B3-2 (Community Business (dash 2)), said section to read as follows:

 

Section 88-20A0971. That an area legally described as:

 

All of Tract B and part of Lot 4, Barry Pointe Office Park – Second Plat, a subdivision of land in Kansas City, Clay County, Missouri, being bounded and described as follows:

 

Beginning at the Southeast corner of said Tract B; thence North 61 degrees 56 minutes 19 seconds West, along the South line of said Tract B and the South line of said Lot 4, 345.83 feet; thence North 28 degrees 03 minutes 41 seconds East, 190.24 feet to the Southwest corner of Lot 6, said Barry Pointe Office Park – Second Plat; thence South 61 degrees 56 minutes 19 seconds East, along the South line of said Lot 6, 345.83 feet to the Southeast corner of said Lot 6, said point also being the Northeast corner of said Tract B; thence South 28 degrees 03 minutes 41 seconds West, along the East line of said Tract B, 190.24 feet to the Point of Beginning. Containing 65,791 square feet or 1.51 acres, more or less.

 

is hereby rezoned from District O-2 (Office (dash 2)) to District B3-2 (Community Business (dash 2)), all as shown outlined on a map marked Section 88-20A0971, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and in accordance with Section 88-20 thereof.

 

Section B. That the rezoning for the area legally described above is subject to the following condition:

 

That uses among the “adult business” use category are prohibited.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
