ORDINANCE NO. 190079

 

Authorizing the City Manager to enter into a $550,000.00 Cooperative Agreement with MCM Company, Inc. (Developer) for the West Bottom Flats Green Infrastructure Project; and recognizing this ordinance as having an accelerated effective date.

 

WHEREAS, the City, as part of its Smart Sewer program, is using green infrastructure projects to reduce the amount of stormwater entering its combined sewer system; and

 

WHEREAS, the City and MCM Company, Inc., desire to incorporate green solutions into the development of the following properties: 915 W. 9th Street, 1529 W. 9th Street, 912 Liberty Street, 925 Wyoming Street, 930 Wyoming Street, and 937 Wyoming Street, Kansas City, Missouri (West Bottom Flats Green Infrastructure Project); and

 

WHEREAS, the West Bottom Flats Green Infrastructure Project, by incorporating green solutions in the development of its properties, serves a public purpose by addressing sewer overflows, improving water quality, and is a benefit to the City’s sewer system and its ratepayers; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to execute a Cooperative Agreement with MCM Company, Inc., for the construction of green infrastructure projects as part of the West Bottom Flats Green Infrastructure Project with a maximum reimbursement amount of $550,000.00 as provided in the agreement.  A copy of the cooperative agreement is on file in the office of Water Services.

 

Section 2. That the Director of Water Services is authorized to expend up to $550,000.00, from Account No. 19-8110-807769-B-611060-60810082, Overflow Control Program, to satisfy the cost of this agreement.

 

Section 3. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.
