ORDINANCE NO. 090153

 

Rezoning an area of approximately 7.1 acres generally located at the northwest corner of N.W. 64th Terrace and N. Cosby Avenue from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), and approving a preliminary development plan for the same. (6576-PD-22).

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That Chapter 80, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Zoning Ordinance, is hereby amended by enacting a new section to be known as Section 80-11A0835, rezoning an area of approximately 7.1 acres generally located at the northwest corner of N.W. 64th Terrace and N. Cosby Avenue from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), said section to read as follows:

 

Section 80-11A0835. That an area legally described as:

 

LOT 2: Lot 2, Wexford Place Second Plat, a subdivision of land in Kansas City, Platte County, Missouri, according to the record plat thereof, containing 125,313.8461 square feet or 2.8768 acres, more or less.

 

TRACT 3; All that part of the Southeast Quarter of Section 19, Township 51, Range 33 and all that part of Lot 2, Wexford Place Second Plat, a subdivision of land all being located in the City of Kansas City, Platte County, Missouri, described as: Beginning at the most easterly corner of Lot 2 of said Wexford Place Second Plat, thence South 58 degrees 56 minutes 00 seconds East, along the southerly line of Lot 1 of said Wexford Place Second Plat, a subdivision of land in said city, county, and state; thence South 07 degrees 22 minutes 05 seconds West, along the westerly line of said Wexford Place Fourth Plat, a distance of 342.58 feet to the southwest corner of said right of way line of N.W. 64th Terrace, as now established; thence westerly and southwesterly, along said northerly right of way line, along a curve to the left having a radius of 825.00 feet, a central angle of 18 degrees 10 minutes 17 seconds and an initial tangent bearing of South 88 degrees 38 minutes 17 seconds West, a distance of 261.65 feet, to a point of tangency; thence South 70 degrees 28 minutes 00 seconds West, continuing along said northerly right of way, a distance of 97.65 feet, to a point of curvature; thence southwesterly and westerly, continuing along said northerly right of way line and its westerly prolongation, along a curve to the right having a radius of 575.00 feet and a central angle of 30 degrees 02 minutes 24 seconds, a distance of 301.47 feet, to a point of intersection with the southerly prolongation of the westerly line of lot 2 of said Wexford Place Second Plat; thence North 19 degrees 54 minutes 00 seconds East, along said prolongation, a distance of 259.52 feet, to a point of intersection with the southwesterly prolongation of the southwesterly line of said Lot 2; thence North 70 degrees 29 minutes 00 seconds East, along said prolongation and along said southeasterly line, a distance of 622.16 feet, to the point of beginning. Containing 183,875.7500 square feet or 4.2200 acres, more or less.

 

is hereby rezoned from District R-4 (Low Apartments) to District PD/R-4 (Planned District/Low Apartments), all as shown outlined on a map marked Section 80-11A0835, which is attached hereto and made a part hereof, and which is hereby adopted as a part of an amendment to the zoning maps constituting a part of said chapter and as an amendment to Section 80-11 thereof.

 

Section B. That a development plan for the area legally described above is hereby approved, subject to the following conditions:

 

1.                  That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of the City of Kansas City, Missouri, commonly known as the Subdivision Regulations

 

2.                  That the developer submit a micro storm drainage study to Development Services for review and acceptance for this phase when the final plat is submitted, and that the developer construct any improvements as required by Development Services.

 

3.                  That the developer secure permits to construct new sidewalks on the north side of N.W. 64th Terrace the length of the project frontage to connect to existing sidewalks to the east and to the west.

 

4.                  That the developer submit plans for grading, siltation, and erosion control to Development Services for review, acceptance, and permitting prior to beginning any construction activities.

 

5.                  That the developer secure a site disturbance permit from Development Services prior to beginning any construction, grading, clearing, or grubbing activities, if the disturbed area equals one acre or more.

 

6.                  That the developer grant a BMP Easement to the City as required by Development Services.

 

7.                  That the developer extend private branch service lines as required by the Water Service Department

 

8.                  That the developer submit a final plan to the City Plan Commission for approval, including detailed information on landscaping, lighting (including a photometric study showing zero footcandles at the property line and no direct illumination beyond the property line) and building elevations.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section C. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by the Zoning Ordinance have been given and had.
