COMMITTEE SUBSTITUTE FOR ORDINANCE NO. 190880

 

Approving an amendment to a development plan in District R-1.5 on about one acre generally located at the southeast corner of E. 24th Street and Elmwood Avenue, to allow for a building addition exceeding ten percent. (CD-CPC-2019-00129)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That an amendment to a development plan in District R-1.5 (Residential 1.5) on about one acre generally located at the southeast corner of E. 24th Street and Elmwood Avenue, and more specifically described as follows:

 

All of Lots 12, 13, 14, 26, 27, 28, 29, 30, 31, and 32 and the west 29.60 feet of Lots 51, 52 and 53 - Ashland Heights, a subdivision of land in Kansas City, Jackson County, Missouri, and Lots 39, 40, 41 and north 26 feet of Lot 42, Gates and Wyatts Addition, a subdivision of land in Kansas City, Jackson County, Missouri.

 

is hereby approved, subject to the following conditions:

 

1.                  Provide additional landscaping along the south side of the addition.

 

2.                  The applicant shall obtain a lot consolidation prior to certificate of occupancy in order to prevent developing across multiple lots.

 

3.                  That the south half of E. 24th Street shall be improved as required by Chapter 88, to current standards, including curbs, gutters, sidewalks, streetlights, relocating any utilities as may be necessary, adjusting vertical grades for the road, and obtaining required permits from the Land Development Division for said improvements prior to recording the plat or prior to issuance of a building permit, whichever occurs first. Provide street lighting along the south side of E. 24th Street. Any waivers must be granted by the Transportation and Development Committee.

 

4.                  The developer shall submit plans for grading, siltation, and erosion control to the Land Development Division for review and acceptance, and secure a site disturbance permit for any proposed disturbance area equal to one acre or more prior to beginning any construction activities.

 

5.                  If the total disturbed area exceeds 10,000 square feet a drainage study will be required, and the developer shall grant a BMP easement to the City as required by the Land Development Division, prior to recording the plat or issuance of any building permits.

 


6.                  The developer shall obtain the executed and recorded City approved grading, temporary construction, drainage/sewer, or any other necessary easements from the abutting property owner(s) that may be required prior to submitting any public improvements crossing properties not controlled by the developer and include said document(s) within the public improvement applications submitted for permitting.

 

7.                  The east half of Elmwood Avenue shall be improved as required by Chapter 88, to current standards, including curbs, gutters, sidewalks, street lights, relocating any utilities as may be necessary, and adjusting vertical grades for the road, and obtaining required permits from the Land Development Division for said improvements prior to recording the plat or prior to issuance of a building permit, whichever occurs first. Provide street lighting along the east side of Elmwood Avenue. Any waivers must be granted by the Transportation and Development Committee.

 

8.                  The developer shall submit fire hydrant installation drawings prepared by a registered professional engineer in Missouri.

 

9.                  The project must meet the fire flow requirements as set forth in Appendix B of the International Fire Code 2012. (IFC-2012: § 507.1)

 

10.              All construction shall be in compliance with the applicable building codes which are in effect at the time of construction and shall be built under valid building permits issued by the City Planning and Development. (IFC-2012: § 102.4)

 

11.              Building shall comply with requirements of wall rating and opening protection per 602 and 705.8 of IBC 2012 with respect to property lines and lot lines.

 

12.              Address requirements for fire sprinkler and fire alarm per chapter 9 of IBC.

 

13.              If the total site disturbance area exceeds 10,000 square feet prior to issuance of any construction permits within a "Combined Sewer Overflow" (CSO) district, the developer shall submit, for review and acceptance, a storm drainage study, sealed by a Missouri-licensed civil engineer, showing detention of the 1.5 inch rainfall depth over the entire disturbed area and release of said volume over a 40- to 72-hour period (unless infiltrated, evaporated, or used in some other manner) in addition to management of the rate and volume of stormwater runoff from the 10% and 1% storms per the latest adopted version of APWA 5600 standards in effect at the time of submission. The developer shall construct improvements necessary to reduce small storm discharges to the combined sewer system by simulating natural runoff conditions through metered release of the 1.5 inch detention volume and mitigate impacts from rate and volume of 10% and 1% storm runoff from the site.

 

A copy of said development plan is on file in the office of the City Clerk with this ordinance and is made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed amendment hereinabove, all public notices and hearings required by law have been given and had.
