ORDINANCE NO. 970753

 

Approving the preliminary plat of Barry Harbor on a 79 acre tract of land located on the south side of N.W. Barry Road at N. Marston Avenue. (SD 00211)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Barry Harbor on a 79 acre tract of land located on the south side of N.W. Barry Road at N. Marston Avenue, and more specifically described as follows:

 

All that part of the Southeast Quarter of Section 9, Township 51, Range 33, Kansas City, Platte County, Missouri, being bounded and described as follows: Beginning at the southeast corner of the Southeast Quarter of said Section 9; thence North 89 21'43" West, along the south line of said Southeast Quarter, 1,670.73 feet to the southeast corner of High View Acres, a subdivision of land in Kansas City, Platte County, Missouri; thence North 0 50'16" East, along the east line of said High View Acres, 2,167.59 feet; thence South 89 17'31" East, 782.29 feet; thence South 0 33'05" West, 136.12 feet; thence easterly along a curve to the left, having an initial tangent bearing of South 69 05'53" East, a radius of 275.00 feet, an arc distance of 176.78 feet; thence easterly and southerly along a curve to the right, having a common tangent with the last described course, a radius of 225.00 feet, an arc distance of 291.18 feet; thence South 89 26'55" East, 449.99 feet to a point on the east line of said Southeast Quarter; thence South 0 33'05" West, along said east line, 1,930.54 feet to the point of beginning.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study and that improvements be made as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval prior to beginning any construction activities.

 

4. That the developer secure a land disturbance permit from the Missouri Department of Natural Resources.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer construct hard surface all-weather roads and provide for fire protection as required by the Fire Department prior to construction beyond

foundations.

 

7. That the developer submit a street tree planting plan for approval with the final plat and secure the approval of the City Forester.

 

8. That the developer extend the covenants and restrictions as required.

 

9. That the developer submit an applicant for rezoning the area of land zoned District C-2 lying within the boundaries of the preliminary plat, such application to be filed at

the time Phase VIII-B is platted.

 

10. That the developer construct temporary cul-de-sacs as required by the Department of Public Works.

 

 

11. That the developer submit a street name sign plan for the entire preliminary plat area for approval by the Street Naming Committee.

 

A copy of the preliminary plat is on file in the office of the City Clerk under Document No. 970753, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
