COMMITTEE SUBSTITUTE
FOR ORDINANCE NO. 110171
Authorizing the Director of
Public Works to enter into a funding agreement and a supplemental municipal
agreement with the Missouri Highways and Transportation Commission related to
improvements to the U.S. 169 Corridor; authorizing the Director of Public Works
to expend $1,950,000.00 for the project; and recognizing an emergency.
WHEREAS, the
City of Kansas City, Missouri (“City”) has obtained a federal surface
transportation program grant of $ 18,268,631.00 to construct interchanges on U.S.
169 at 96th and 108th Street and City streets that connect to the
interchanges; and
WHEREAS; the
interchanges will be owned and maintained by the Missouri Highways and
Transportation Commission (“MoDOT”); and
WHEREAS, the
City is working in partnership with MoDOT where the City is providing funding
for the design of the interchanges and MoDOT is providing project management
and oversight which will include bidding and inspecting the project; and
WHEREAS, the
Second Council District funded $1,950,000.00 for the design of these
improvements from general obligation bonds with Ordinance No. 101072 and
Committee Substitute for Ordinance No.110062; and
WHEREAS, the
City and MoDOT would like to complete the design to allow the bidding of the
project in October 2011 by beginning the engineering for the project
immediately; and
WHEREAS, these
interchanges have been planned for a long period of time; and
WHEREAS, the
City and MoDOT entered into a maintenance agreement executed by the City with
Ordinance No. 47876 on July 5, 1977, and by the Commission on August 10, 1977;
and
WHEREAS, the
purpose of the Agreement was to provide for adjustments and for City
maintenance of streets adjusted, relocated, or reconstructed; and
WHEREAS, upon
completion of the separate jobs indicated by the Commission, the City was to
keep, control, and maintain for all purposes as parts of the City street system
those sections of streets impacted by the agreement; and
WHEREAS, some of
the jobs identified in the agreement have not been completed; and
WHEREAS, the agreement
listed in Exhibit B-2, Job No. 4-U152-29D three portions of N.W. 96th Street to
be relocated, reconstructed, and improved; and
WHEREAS, the
first segment of N.W. 96th Street listed in the Agreement was the connection of
west of U.S. 169 in the southwest quarter of the southeast quarter and the
southeast quarter of the southeast quarter of Section 34, Township 52 North,
Range 33 West where local maintenance is to be between Station 10+95 and
Station 33+80, a total distance of 0.43 miles; and
WHEREAS, the
City desires the modification of the west connection of N.W. 96th Street to
U.S. 169 and approved the modification by amending the Major Street Plan with
Ordinance No. 061235 which was passed on November 30, 2006; and
WHEREAS, the
City is designing improvements and would like to assume maintenance of the
right of way in the southwest quarter of the southeast quarter and the southeast
quarter of the southeast quarter of Section 34, Township 52 North, Range 33
West between Station 10+95 and Station 33+80, a total distance of 0.43 miles
before Job No. 4-U152-29D is complete and needs to enter into a supplemental
agreement to facilitate these changes; NOW, THEREFORE,
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section 1. That
the Director of Public Works is hereby authorized to execute, on behalf of
Kansas City, a $1,950,000 Funding Agreement with the Missouri Highways and
Transportation Commission. A copy of this agreement is on file in the office
of the Director of Public Works.
Section 2. That
the Director of Public Works is authorized to expend $1,950,000 from funds
previously appropriated to the following accounts:

169 Interchanges $ 750,000.00
AL- 3397-898201-B-89005554 US
169 Interchanges 1,200,000.00
TOTAL $1,950,00000
Section 3. That
the Director of Public Works is hereby authorized to execute, on behalf of
Kansas City, a Supplemental Municipal Agreement with the Missouri Highways and
Transportation Commission for the maintenance agreement entered into and
executed by the City with Ordinance No. 47876 on July 5, 1977, and by the
Commission on August 10, 1977. A copy of this agreement is on file in the
office of the Director of Public Works.
Section 4. That
this ordinance is recognized as an emergency measure within the provisions of
Section 503 of the City Charter in that it relates to a public improvement, and
shall take effect in accordance with that section.

I hereby certify
that there is a balance, otherwise unencumbered, to the credit of the
appropriation to which the foregoing expenditure is to be charged, and a cash
balance, otherwise unencumbered, in the treasury, to the credit of the fund from
which payment is to be made, each sufficient to meet the obligation hereby
incurred.
