ORDINANCE NO. 030795

 

Authorizing a $286,937.50 contract with Commanche Construction, Inc., for emergency sidewalk and railing removal on the Manchester Trafficway Bridge over the Union Pacific Railroad; estimating revenue in the amount of $229,000.00 in the Capital Improvement Fund; appropriating it to the Manchester Bridge account of the Capital Improvement Fund; authorizing the Director of Public Works to expend $307,000.00 for the project; and recognizing an emergency.

 

WHEREAS, approximately 120 feet of railing and sidewalk on the west side of Span 16 fell off the Manchester Bridge while Southwestern Bell Corporation was taking off their conduits from the bridge; and

 

WHEREAS, City staff and engineers from HNTB investigated the site and found the remaining sidewalk is spalled with severely deteriorated reinforcement; and

 

WHEREAS, for safety reasons, City staff closed the bridge to traffic; and

 

WHEREAS, the immediate preservation of the public peace, property, health, safety or morals, requires this ordinance to take effect immediately; NOW, THEREFORE

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the work of providing emergency sidewalk and railing removal on the Manchester Trafficway Bridge over Union Pacific Railroad, consisting of removal of sidewalk and railing off bridge and bridge deck over the hump yard, and other necessary appurtenances, all in Kansas City, Jackson County, Missouri, Project No. 5516, Federal Project No. BRM-3319(411), is hereby provided for and authorized.

 

Section 2. That the work shall be done in accordance with the plans, specifications and the contract therefore between Kansas City, Missouri, through its Director of Public Works, and Commanche Construction, Inc., a foreign corporation, in the amount of $286,937.50, which contract is hereby approved and confirmed. A copy of the contract is on file in the office of the Director of Public Works and is incorporated herein by reference.

 

Section 3. That the revenue in the following account of the Capital Improvement Fund is hereby estimated in the following amount:

 

04-309-089-7861 STP Grant - Manchester Bridge $229,000.00

 

Section 4. That the sum of $229,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvement Fund to the following account in the Capital Improvement Fund:

 


04-309-089-7188-T Manchester Bridge of UPRR $229,000.00

 

Section 5. That the Director of Public Works is hereby authorized to expend the sum of $307,000.00 from funds heretofore appropriated to Account No. 04-309-089-7188-T for the aforesaid contract and for engineering associated herewith.

 

Section 6. That this ordinance, being for the immediate preservation of public property and safety, is hereby declared to be an emergency measure within the provisions of Article II, Section 15 of the Charter and shall take effect in accordance with said section.

I hereby certify that there is a balance, otherwise unencumbered, to the credit of the appropriation to which the foregoing expenditure is to be charged, and a cash balance, otherwise unencumbered, in the treasury, to the credit of the fund from which payment is to be made, each sufficient to meet the obligation hereby incurred.
