ORDINANCE NO. 970124

 

Approving the preliminary plat of Fairfield on a 119 acre tract of land generally bounded by N. Oak Trafficway on the west, N. Woodland Avenue on the east, Interstate 435 on the north, and N.E. Cookingham Drive on the south. (SD 0765)

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section A. That the preliminary plat of Fairfield on a 119 acre tract of land generally bounded by N. Oak Trafficway on the west, N. Woodland Avenue on the east, Interstate 435 on the north, and N.E. Cookingham Drive on the south, and more specifically described as follows:

 

A tract of land located in the East Half of Section 23, Township 52 North, Range 33 West, also partly in the Northwest Quarter of Section 24, Township 52 North, Range 33 West of Kansas City, Clay County, Missouri. More particularly described as follows: Commencing at the northeast corner of Section 23, Township 52 North, Range 33 West, also being the point of beginning, thence South 89 31'24" East, along the north line of Section 24, Township 52 North, Range 33 West, a distance of 850.83 feet, thence South 86 15'34" East a distance of 462.45 feet; thence South 00 23'52" West, a distance of 1307.71 feet; thence North 89 29'29" West, a distance of 1311.84 feet to a point on the east line of Section 23, Township 52 North, Range 33 West; thence South 00 22'12" West, along the east line of Section 23, Township 52 North, Range 33 West, a distance of 1293.17 feet; to a point on the north right of way of Missouri Route 291, also known as Cookingham Drive; thence North 89 10'33" West, along said right of way line, a distance of 1312.66 feet; thence North 00 22'27" East a distance of 2,617.30 feet to the north line of Section 23, Township 52 North, Range 33 West; thence South 89 34'34" East along the north line of Section 23, Township 52 North, Range 33 West, a distance of 463.23 feet; thence South 77 00'42" East, a distance of 102.27 feet; thence South 89 06'07" East, a distance of 400.00 feet; thence North 76 06'53" East, a distance of 103.40 feet to a point on the north line of Section 23, Township 52 North, Range 33 West; thence South 89 34'34" East along the north line of Section 23, Township 52 North, Range 33 West, a distance of 249.20 feet to the point of beginning. Containing 118.76 acres, more or less.

 

is hereby approved, subject to the following conditions:

 

1. That the developer cause the area to be platted and processed in accordance with Chapter 66, Code of Ordinances of Kansas City, Missouri, as amended, commonly

known as the Subdivision Regulations.

 

2. That the developer submit a storm drainage study for the entire development and that improvements be made as required by the City Engineer's Office.

 

3. That the developer submit plans for grading and siltation and erosion control to the City Engineer's Office for approval including an area designated for the purposes of

a silt basin for the pond for permitting prior to beginning any construction activities.

 

4. That the developer secure a permit from the Missouri Highway and Transportation Department prior to working in State right of way.

 

5. That the developer extend water mains as required by the Water Services Department.

 

6. That the developer provide for fire protection as required by the Fire Department.

 

7. That the developer obtain a land disturbance permit from the Missouri Department of Natural Resources if the disturbed area for the entire development exceeds five

acres.

 

8. That the developer submit a street tree planting plan with the final plat and secure the approval of the City Forester.

 

9. That the developer extend sanitary sewers as required by the City Engineer's Office.

 

10. That the developer submit covenants and restrictions for a homes association to maintain the pond and open space.

 

11. That the developer secure the approval of the Street Naming Committee for all street names prior to the submittal of the final plat.

 

12. That the developer dedicate additional right of way for N.E. Cookingham Drive to the Department of Public Works so as to insure 50 feet of right of way as measured from

the centerline of N.E. Cookingham Drive.

 

13. That the developer improve one-half of N.E. Cookingham Drive to primary arterial street standards.

 

14. That the developer construct temporary cul-de-sacs as required by the City Engineer's Office.

 

15. That the developer show limits of the 100 year floodplain on the final plat.

 

16. That the developer apply for a floodplain certificate prior to working within any floodplain area.

 

17. That the developer obtain Board of Zoning Adjustment approval prior to the issuance of a permit for any monument signage identifying the subdivision.

 

18. That the developer dedicate the open space identified in Phase I located at the southwest corner as public parkland.

 

19. That the developer complete a traffic study to be submitted as required by the City Engineer's Office.

 

20. That the developer submit a noise level study for I-435 adjacent to the subdivision.

 

21. That the developer not construct any structure or outdoor living area within the 65 dBA noise level contour.

 

22. That the developer comply with the Kansas City International Airport height zoning restrictions.

 

23. That the developer perform an environmental audit and submit it to the Parks and Recreation Department for approval.

 

A copy of said preliminary plat is on file in the office of the City Clerk under Document No. 970124, which is attached hereto and made a part hereof.

 

Section B. That the Council finds and declares that before taking any action on the proposed preliminary plat hereinabove, all public notices and hearings required by the Subdivision Regulations have been given and had.
