Approving the preliminary plat of Williams Addition on a
0.53 acre tract of land generally located at 3115 Charlotte and 817 E. 31st
Street. (SD 1387)
BE IT ORDAINED
BY THE COUNCIL OF KANSAS CITY:
Section A. That
the preliminary plat of Williams Addition on a 0.53 acre tract of land
generally located at 3115 Charlotte and 817 E. 31st Street, and more
specifically described as follows:
All that part of Lots
16, and 19 thru 23, Resurvey of Lots 5-8 and 12-15 Chadwick's Subdivision, and
all that part of Lots 8 and 9, Logan Place, both being subdivisions in Kansas City,
Jackson County, Missouri, being described as follows: Commencing at the ne
corner of the SE 1/4 of Section 17, Twp. 49 Rng. 33; thence N 8706'58" W,
along the north line of said SE 1/4, 851.55 feet; thence S 253'02" W,
25.00 feet to a point being the northeast corner of a tract of land as
described in a recorded Document NO. 2007E0059342 at the Jackson County Recorders
Office, said point also being the point of beginning; thence S 226'13" W,
along the east line of said tract, 129.18 feet to a point on the south line of
said Lot 23; thence N 8706'56" W, along said south line, 80.04 feet to a
point on the east line of said Lot 16, said point also being the southwest corner
of said Lot 23; thence S 226'13" W, along said east line of Lot 16,
105.15 feet; thence N 8706'56" W, 10.00 feet; thence S 226'13" W,
5.00 feet; thence N 8706'56" W, 187.34 feet to the southwest corner of a
tract of land as described in a recorded Document No. 2004K0048128 at the Jackson
County Recorders Office; thence N 226'22" E, along the west line of said
tract, 40.06 feet to the northwest corner of said tract; thence S 8706'56"
E, along the north line of said tract, 167.32 feet to a point being the northeast
corner of said tract, said point also being on the west line of the East 1/2 of
said Lot 16; thence N 226'15" E, along said west line, 199.28 feet to the
northwest corner of a tract of land as described in said Document No. 2007E0059342;
thence S 8706'58" E, along the north line of said tract, 110.06 feet to
the point of beginning. Containing 24,175 square feet or 0.550 acres
is hereby approved, subject to
the following conditions:
1. That the developer cause the area to be platted and processed
in accordance with Chapter 66, Code of Ordinances of the City of Kansas City,
Missouri, commonly known as the Subdivision Regulations.
2. That the developer contribute $233.31 in lieu of parkland
dedication for 1 residential unit (1 units [3.7 for SF] .006 $10,509.41 (year
2008) = $233.31) in satisfaction of Section 66-128 of the Subdivision
Regulations.
3. That the developer submit a letter from a licensed civil engineer,
licensed architect, or licensed landscape architect, who is registered in the
State of Missouri, stating the condition of the sidewalks, curbs, and gutters.
The letter must identify state of repair as defined in Chapters 56 and 64, Code
of Ordinances, for the sidewalks, curbs, and gutters. It shall identify the
quantity and location of sidewalks, curbs, and gutters that need to be
constructed, repaired, or reconstructed. The developer shall secure permits to
repair or reconstruct the identified sidewalks, curbs, and gutters as necessary
along all development street frontages, as required by Development Services,
prior to recording of the final plat.
4. That the developer submit plans for grading, siltation, and
erosion control to Development Services for review, acceptance, and permitting
prior to beginning any construction activities.
5. That the developer enter into a pedestrian right-of-way
access easement for the portion of the public sidewalk located outside of the
public right-of-way, as required by Development Services, prior to recording of
the final plat.
A copy of the preliminary plat is
on file in the office of the City Clerk with this ordinance and is made a part
hereof.
Section B. That
the Council finds and declares that before taking any action on the proposed
preliminary plat hereinabove, all public notices and hearings required by the
Subdivision Regulations have been given and had.
